NARENDRA PRASAD ORAL ORDER This writ petition is filed by defendant No.1 under Article 227 of the Constitution of India, challenging the order dated 31.08.2023 passed by the III Additional District and Sessions Judge, Ramanagara, whereby the order passed by the Senior Civil Judge and JMFC, Channapattana, dated 25.05.2002 in O.S.No.44/2021 was confirmed. - 4 - NC: 2025:KHC:5622 WP No. 24787 of 2023

2. The plaintiffs filed a suit for cancellation of the agreement of sale dated 11.01.2023. Along with the plaint, they filed an application under Order XXXIX Rules 1 and 2.

3. After hearing the parties, the trial court, by order dated 25.05.2022 allowed the application. Being aggrieved by the same, the defendant No.1 filed an appeal before the I Appellate Court in M.A.No.23/2022. The I Appellate Court, by order dated 31.08.2023 dismissed the appeal. Hence, the defendant No.1 is before this Court.

4. The only grievance of the petitioner/defendant No.1 is that, the plaintiff is trying to alienate the property and also trying to put up construction on the suit schedule property when the suit is pending before the trial court for consideration.

Operative part

5. Now, that the suit is at the stage of evidence of the parties. Under the circumstances, the following order is passed: - 5 - NC: 2025:KHC:5622 WP No. 24787 of 2023 The writ petition stands disposed of with a direction to the respondents/plaintiffs not to create any third party interest in respect of the suit schedule property. It is made clear that they shall not claim any equity, in any construction made in the suit schedule property, in case, if they fail in the suit.
