Accused No.4 in Crime No.194 of 2026 registered by Anekal Police Station, Bengaluru District for offence punishable under Section 109 R/w Section 3(5) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail.

Heard the learned counsel for the petitioner and learned Addl. State Public Prosecutor for respondent - State.

FIR in Crime No.194 of 2026 was registered by Anekal Police Station, Bengaluru District for the aforesaid offence against Sri Suresh and three others, based on the first information dated 14.07.2026 received from Smt. Shashikala, who is one of the injured victim. In the present case, during the course of investigation, the petitioner was arrested on

14.07.2026 and remanded to judicial custody. Her bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.5357 of 2026 was rejected on 25.07.2026. Therefore, she is before this Court. HC-KAR - 3 - NC: 2026:KHC:45469 CRL.P No. 12623 of 2026 CNR: KAHC010568662026

In the first information, it is stated that, on

13.07.2026 at about 07.00 p.m. accused no.1 and Chandra, who is the brother of the first informant had quarreled with each other on some petty issues. Subsequently, the said quarrel was pacified. But thereafter, accused nos.1 to 4 named in the FIR allegedly came near the house of Chandra and after abusing the inmates of the house, they assaulted Chandra and others. Petitioner is the wife of accused no.1 - Suresh. Allegation against her is that, she had abused and assaulted the victim with her hands and legs.

Petitioner who is a lady aged 38 years is in custody for the last more than 1 month. Learned counsel for the petitioner has submitted that the petitioner has two children, who are required to be taken care of.

Considering the nature of allegations found as against the petitioner and also having regard to the proviso to Section 480 of BNSS, 2023, I am of the opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following: HC-KAR - 4 - NC: 2026:KHC:45469 CRL.P No. 12623 of 2026 CNR: KAHC010568662026 (i) (ii) ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.194 of 2026 registered by Anekal Police Station, Bengaluru District for offence punishable under Section 109 R/w Section 3(5) of BNS, 2023 subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts her appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
