JUSTICE S.R.KRISHNA KUMAR - 2 - NC: 2026:KHC:7242 WP No. 24889 of 2025 HC-KAR ORAL ORDER In this petition, petitioner seeks the following reliefs: “a) Issue a writ of certiorari or any other appropriate writ, order, quashing the entire Proceedings in Ex. No.20/2022 pending on the Senior Civil Judge & JMFC, Gundlepet (Annexure-C) as the same are illegal, arbitrary and in violation of the principles of natural justice. b) Issue a writ of mandamus or any other appropriate writ, order or direction directing the Respondent to grant all the consequential benefits consequent upon quashing the proceedings at Annexure-C.”

#2. Heard learned counsel for the petitioner and learned counsel for the respondent and perused the material on record.

#3. After arguing the matter for sometime, learned counsel for the petitioner submits that the petitioner would file objections to the main execution proceedings and contest the same accordance with law.

#4. Learned counsel for the respondent submits that the Executing Court may be directed to dispose of the execution proceedings as expeditiously as possible. - 3 - NC: 2026:KHC:7242 WP No. 24889 of 2025 HC-KAR

#5. The aforesaid joint submission is placed on record.

#6. Accordingly, the petition stands disposed of reserving liberty in favour of the petitioner to file objections to the main execution petition. Upon the petitioner filing objections, Executing Court shall consider the same and hear both sides and dispose of the execution proceedings within a period of 6 months from the date of receipt of a copy of this order.
