THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner has sought for the following relief:- “A) Quash the entire Charge-Sheet and consequently the proceedings in Crime No.42/2024 registered with the Sheshadripuram P.S. for the offence p/u/s 506, 504, 323, 324 r/w 34 of IPC in so far as the petitioner is concerned, now pending on the file of Hon’ble I Additional Chief Metropolitan Magistrate court, at Bengaluru in C.C.No.16258/2024 for the offences p/u/s 323, 324, 341, 504, 506 of IPC. B) Pass such other order or orders as this Hon’ble Court may deem fit in the facts and circumstances of the case in the ends of justice.” 2. Learned counsel for the petitioner – accused No.1 and learned counsel for the respondent No.2 – complainant have filed an Application under Section 359 r/w. 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 along with joint affidavit dated 27.06.2025, - 3 - NC: 2025:KHC:22833 CRL.P No. 8809 of 2025 HC-KAR duly signed by the petitioner, 2nd respondent and their respective counsel and the same is taken on record. 3. Petitioner – accused No.1, respondent No.2 – complainant and their respective counsel are physically present before the Court and they admit the contents of the aforesaid Application and affidavit, which read as under:- “APPLICATION FILED UNDER 359 R/W 528 OF BHARATIYA NAGARIK SURAKSHA SANHITA, 2023. The Petitioners and Respondent No.2 submits as follows: 1. Though the offences alleged in the charge sheet is under Section 323, 324, 341, 504, 506 of IPC in charge sheet for which respondent have filed the accused persons is very innocent and he has not involved in the incident and therefore to meet the ends of justice proceedings in necessary to be quashed. 2. It is submitted that the Petitioner has preferred the main petition to quash the proceedings in C.C.No.16258/2024 on the file of Hon’ble I Addl. Chief Judicial Magistrate at Bangalore which is arising out of Crime No.42/2024 of Sheshadripuram Police Station, Bangalore for offences under sections 323, 324, 341, 504, 506 of IPC. - 4 - NC: 2025:KHC:22833 CRL.P No. 8809 of 2025 HC-KAR 3. It is submitted that, the Petitioner and Respondent No.2 have decided to put an end to the proceedings in C.C.No.16258/2024 and lead their personal life cordially and therefore the second Respondent has agreed to quash the proceedings in C.C.No.16258/2024 on the file of Hon’ble I Addl. Chief Judicial Magistrate at Bangalore which is arising out of Crime No.42/2024 of Sheshadripuram Police Station, Bangalore for the offences under sections 323, 324, 341, 504, 506 of IPC and there is no coercion or force is applied on the Respondent No.2 4. In view of settlement in between Petitioner and Respondent No.2, the Petitioner has agreed to settle the matter and to lead their personal life. Wherefore, the Petitioner and the Respondent No.2 pray this Hon’ble Court to quash the proceedings in C.C.No.16258/2024 on the file of Hon’ble I Addl. Chief Judicial Magistrate at Bangalore which is arising out of Crime No.42/2024 of Sheshadripuram Police Station, Bangalore for the offences under sections 323, 324, 341, 504, 506 of IPC in the ends of justice.” “JOINT AFFIDAVIT” Sri Madhu, S/o Ramdas, Aged about 32 years, R/at No. 179, 2nd Main, Risildarstreet, Sheshadripuram, Bengaluru – 560 020. - 5 - NC: 2025:KHC:22833 CRL.P No. 8809 of 2025 HC-KAR AND Sri. Guru, S/o Rajegowda, Aged about 35 years, R/at No.34, 1st Main, 2nd Block, Srirampura, Bengaluru – 560 021. 1. We are well conversant with the facts of the above application. Hence, we are swearing to this joint affidavit. 2. The averments made in the accompanying application from Paras 1 to 4 for settlement and to quash the proceedings are true and correct to the best of our knowledge, information and belief. 3. We both have decided to put an end to the proceedings in C.C.No.16258/2024 (Crime No.42/2024 of Sheshadripuram Police Station, Bangalore) now on the file of the Hon’ble I Addl. Chief Judicial Magistrate at Bangalore) for offences p/u/s 323, 324, 341, 504, 506 of IPC and lead our personal life cordially. I second of me agreed to quash the proceeding in C.C.No.16258/2024 now on the file of the Hon’ble I Addl. Chief Judicial Magistrate at Bangalore in the ends of Justice.” 4. Decision
ORDER (i) The petition is disposed of in terms of Application filed under Section 359 r/w. Section 528 of BNSS, 2023 and the joint affidavit, both dated 27.06.2025. (ii) The proceedings in Crime No.42/2024 (arising out of Crime No.42/2024 of 1st respondent – Police) registered for the offences punishable under Sections 323, 324, 341, 506, 504, r/w. Section 34 of IPC pending on the file of I Additional Chief Metropolitan Magistrate, Bengaluru, insofar as the petitioner- accused No.1 is concerned are hereby quashed.
