A writ in the nature of mandamus or any other appropriate writ or order declaring that the petitioners are entitled to gratuity on the basis of ceiling limit of Rs.10,00,000 and for a direction to the third respondent to calculate the gratuity payable to the petitioners on a ceiling of Rs.10,00,000 and pay the differential amount to the petitioners along with interest at 8.5% per annum from the date gratuity was paid treating Rs.3,50,000/- as ceiling, till date of payment.

The case of the petitioners is that, the first petitioner is an Association registered under the Karnataka Societies Registration Act, 1960 and petitioner Nos. 2 to 694 are retired workmen of B.E.M.L., Bengaluru. They retired during the period from 01.01.2007 to 23.05.2010. The salary structure of these workmen was governed by settlements entered into between the Management and the workmen under the provisions of the Industrial 127 Disputes Act, 1947 (for short, the “ID Act”). At the time of retirement, the petitioners–workmen were paid gratuity up to a maximum amount of Rs.3,50,000/- in terms of the provisions of the Payment of Gratuity Act, 1972 (for short, ‘1972 Act’).

On 26.11.2008, the Central Government issued an Office Memorandum directing that the ceiling on gratuity payable to Executives and non- unionized Supervisors of Central Public Sector Enterprises be enhanced to Rs.10.00 lakhs with effect from 01.01.2007. On the basis of the said Office Memorandum, notwithstanding the fact that the 1972 Act provides for a maximum gratuity of Rs.3,50,000/-, officers of HAL, which is a Public Sector Undertaking under the Ministry of Defence, were granted gratuity up to Rs.10.00 lakhs.

Since the officers - ex-employees of BEML were not extended the same benefit, they approached 128 this Court by filing W.P.Nos.36530–36708/2016 C/w.W.P.No.53708/2013. This Court, by order dated

11.01.2019, disposed of the writ petitions. Aggrieved by the said order of the learned Single Judge, the retired officers of BEML filed W.A.No.443/2019 C/w. W.P.No.23629/2019. A Division Bench of this Court disposed of the writ appeal on 05.03.2021, directing BEML to enhance the gratuity payable to the retired officers of BEML to the ceiling limit of Rs.10.00 lakhs. That order was challenged before the Apex Court in SLP(C) Nos.16004-16005/2021. The Apex Court confirmed the order passed by the Division Bench dated

05.03.2021. Thereafter, the benefit was extended to the officers of the BEML establishment. In meantime, the retired workmen of the BEML also submitted representations seeking enhancement of gratuity from Rs.3.5 lakhs to Rs.10.00 lakhs for the period from 01.01.2007 to 23.05.2010. However, the same benefit was not granted to the petitioners, and 129 their representations remain unconsidered. Hence, the petitioners are before this Court.

Sri S.N.Murthy, learned Senior Counsel appearing for the petitioners raised the following contentions: (i) Firstly, even though the 1972 Act has fixed the ceiling limit of Rs.3.5 lakhs in respect of officers, the Ministry of Heavy Industries and Public Enterprises, Department of Public Enterprises issued certain guidelines regarding the salaries of officers and revision of pay scales with effect from 01.01.2007, and also issued guidelines enhancing the ceiling limit for payment of gratuity to Rs.10.00 lakhs with effect from 01.01.2007. Pursuant to the guidelines issued by the Ministry of Heavy Industries and Public Enterprises, HAL enhanced the gratuity payable to its employees. On similar lines, the third respondent– establishment enhanced the gratuity payable to the 130 retired officers of the third respondent–Public Sector Limited, based on the directions issued by a Division Bench of this Court in W.A. No.443/2019.

He further contended that, under the 1972 Act, the term “employee” includes both “officers” and “workmen.” Therefore, respondents cannot discriminate between officers and workmen. Having enhanced the gratuity ceiling from Rs.3.5 lakhs to Rs.10.00 lakhs and extended the benefit to officers, the respondents cannot deny the same benefit to workmen. Such action on the part of the respondents is violative of Article 14 of the Constitution of India. (ii) Secondly, the reason assigned by the third respondent in the Statement of Objections, namely that the request of the employees’ Association in the Charter of Demands for payment of gratuity was rejected, is untenable. The request made by the Association was only with respect to amendment of 131 the 1972 Act. The third respondent is admittedly not the competent authority to amend the said Act, and therefore the request was rejected. However, such rejection cannot operate as a bar for the third respondent to enhance the gratuity payable to the petitioners from Rs.3.5 lakhs to Rs.10.00 lakhs.

(iii) Thirdly, with regard to the demand made by the Association seeking amendment of the 1972 Act, it is evident that the third respondent cannot amend a Central enactment. Therefore, whether Management agrees to such a demand or not is of no legal consequence, and no significance can be attached to the same. (iv) Fourthly, as per the guidelines issued by the Ministry of Heavy Industries and Public Enterprises, if a Public Sector Establishment is making profits, it is required to enhance the gratuity amount from Rs.3.5 lakhs to Rs.10.00 lakhs. The respondent No.3 132 establishment is a profit-making entity. In view of the said guidelines, the third respondent is obligated to enhance the gratuity payable to the petitioners from Rs.3.5 lakhs to Rs.10.00 lakhs. In support of this contention, reliance is placed on the judgment of the Apex Court in D.S. NAKARA AND OTHERS vs. UNION OF INDIA, reported in (1983) 1 SCC 305, wherein it is held that pension is neither a bounty nor a matter of grace depending upon the sweet will of the employer, but a payment for past services rendered and a social welfare measure intended to render socio-economic justice to employees who devoted their productive years to service with the assurance of security in old age.

(v) Fifthly, the settled principle of law is that, when a particular set of employees are granted relief by a Court, all other identically situated persons are entitled to similar treatment by extension of the same benefit. Failure to do so would amount to discrimination and would be violative of Article 14 of the Constitution of 133 India. In support of this contention, reliance is placed on the judgment of the Apex Court in STATE OF UTTAR PRADESH AND OTHERS vs. ARVIND KUMAR SRIVASTAVA AND OTHERS, reported in (2015) 1 SCC 347. (vi) Sixthly, weaker sections, including workmen, and their welfare benefits such as pension, provident fund, and gratuity are intended to fulfill the Directive Principles of State Policy. In such matters, decisions are required to be taken in good faith and with due care, and not as a measure of reprisal. In support of this contention, reliance is placed on the judgment of the Apex Court in SOMPRAKASH REKHI VS. UNION OF INDIA AND ANOTHER, reported in (1981) 1 SCC

449. (vii) Seventhly, while construing Articles 14 and 16 of the Constitution of India, in the light of the Preamble and Article 39(d) of the Constitution of India, the 134 principle of “equal pay for equal work” is applicable to cases where different scales of pay are prescribed for identical work under the same employer. In support of this contention, reliance is placed on the judgment of the Apex Court in RANDHIR SINGH VS. UNION OF INDIA AND OTHERS, reported in (1982) 1 SCC 618. Hence, the petitioner seeks for allowing of the writ petition.

Per contra, Sri S.S.Naganand, learned Senior Counsel appearing for the respondents, raised the following contentions: (i) Firstly, petitioner Nos.2 to 694 retired during the period from 01.01.2007 to 23.05.2010. After a lapse of more than 11 years, they have filed the present writ petition. There is an inordinate delay in approaching this Court. In the pleadings, there is no explanation whatsoever for the delay in filing the writ petition. 135 (ii) Secondly, on 26.11.2008, the Government of India, Ministry of Heavy Industries and Public Enterprises, Department of Public Enterprises issued an Office Memorandum enhancing the ceiling limit of gratuity for Executives and non-unionised Supervisors of Central Public Sector Enterprises (CPSEs) to Rs.10.00 lakhs with effect from 01.01.2007. The petitioners’ demand for enhancement of gratuity was denied pursuant to the Charter of Demands in the year 2009, which they accepted.

Thereafter, after a lapse of 11 years, they have approached this Court by filing the present writ petition. It is only pursuant to the directions issued by this Court in W.A. No.443/2019 C/w. W.P.No.53708/2013, disposed of on 05.03.2021, that they have now approached this Court. Therefore, they are not entitled to any relief at the hands of this Court. Delay defeats equity, and on this ground alone, the writ petition is liable to be dismissed. 136 (iii) Thirdly, the petitioners were members of a recognised trade union of the answering respondent. Accordingly, for the purpose of wage revision for unionised employees who were on the rolls of the third respondent as on 01.01.2007, the unions submitted their Charter of Demands in respect of wages and allied matters, and negotiations were commenced. A revised Charter of Demands of the BEML Employees Association was prepared, and the parties ultimately arrived at a settlement under a Memorandum of Settlement dated 24.01.2011, duly signed by the representatives of the Management and the recognised unions of all divisions of the answering respondent.

Under Section 12(3) read with Section 18(3) of the Industrial Disputes Act, 1947, the said settlement is binding on both the petitioners and the answering respondent. As per the settlement, the demand of the union for enhancement of service 137 gratuity was expressly denied. Thereafter, the policy on wage revision for workmen was issued by way of General Bulletin dated 24.01.2011, as per Annexure R-7. In view of the same, the petitioners cannot now seek enhancement of the ceiling limit of gratuity from Rs.3.5 lakhs to Rs.10.00 lakhs. (iv) Fourthly, workmen and executives stand on different footings insofar as their employment, remuneration, and the applicability and methodology of salary revision are concerned. The service conditions of workmen are regulated by the Standing Orders applicable to them and by the tri-partite Memorandum of Settlement entered into between the Management and the recognised unions. Therefore, it is contended that enhancement of the gratuity ceiling for executives and denial of the same benefit to workmen would not amount to discrimination. 138 (v) Fifthly, the Office Memorandum dated

26.11.2008 issued by the Government of India, Ministry of Heavy Industries and Public Enterprises, Department of Public Enterprises (Annexure A), is applicable only to Executives and non-unionised Supervisors of CPSEs. The petitioners are members of a recognised union and therefore cannot claim parity with Executives or non-unionized Supervisors of CPSCs. In respondent–Establishment, employees are classified into two categories, namely workmen and officers. Wage revision for workmen is arrived at through a tri-partite settlement between the recognised unions of all divisions and the Management under Section 12(3) read with Section 18(3) of the Industrial Disputes Act, 1947. Based on the Charter of Demands submitted by the recognised unions and prolonged negotiations spanning nearly ten years, a Memorandum of Settlement was executed containing 139 the terms and conditions of service before the competent authority. Therefore, the petitioners cannot claim equality with non-unionised employees. Consequently, enhancement of the gratuity ceiling for officers of respondent–Establishment pursuant to the directions of the Division Bench of this Court, and denial of the same relief to the petitioners, does not amount to discrimination. In support of this contention, reliance is placed on the judgments of the Apex Court in the case of STATE OF ORISSA vs. PYARIMOHAN SAMANTARAY AND OTHERS reported in (1977) 3 SCC 396 and in the case of K.V.RAJALAKSHMIAH SETTY AND ANOTHER vs. STATE OF MYSORE AND ANOTHER reported in 1966 SCC Online SC 77 and judgment of the Delhi High Court in the case of SAIL EX-EMPLOYEES ASSOCIATION vs. STEEL AUTHORITY OF INDIA 140 AND ANOTHER reported in 2009 SC Online Del

By way of rejoinder, learned Senior Counsel appearing the petitioners submitted on contention of delay, that there is no delay in filing this writ petition. Even after their retirement, the petitioners have been continuously submitting representations to the Hon’ble Ministers, vide Annexure-J dated 31.10.2014 and Annexure-K dated 27.01.2016, and have been agitating their rights since then. The petitioners are retired employees respondent– Establishment. The Payment of Gratuity Act is a beneficial piece of legislation, and gratuity is not a bonus but a statutory payment in consideration of the services rendered by the employees. Therefore, the rights of the petitioners cannot be denied solely on the ground of delay. Further, it is contented that similar public sector undertakings like HAL, BEL and Bharat Dynamics 141 workmen were paid. Hence, he prayed for allowing the writ petition.

Heard the learned counsel for the parties and perused the writ petition papers.

The first petitioner is an Association of ex- employees of respondent–Company. Petitioner Nos. 2 to 694 are workmen who retired from the service of the third respondent during the period from 01.01.2007 to 23.05.2010 and they are the members of the first petitioner.

The principal grievance of the petitioners is that the benefit of enhanced gratuity of Rs.10.00 lakhs has not been extended to them even though same benefit has been extended to the officers of the third respondent – Company which is violation of Article 14 of the Constitution of India. 142

For the following reasons, the petitioners are not entitled to the benefit of enhanced gratuity of Rs.10.00 lakhs: A. The specific contention of the petitioners is that, pursuant to the Office Memorandum dated 26.11.2008, enhancement of the ceiling limit of gratuity should also apply to workmen who retired between 01.01.2007 and

23.05.2010, and that the definition of “employee” under the Gratuity Act includes both workmen and officers. The O.M. dated 26.11.2008 is not issued under the 1972 Act and also the said O.M. is not applicable to the unionized workmen. The petitioners case is considered under the 1972 Act, the ceiling limit of gratuity was Rs.3.5 lakhs up to

23.01.2010. By Notification dated 17.05.2010, published in the Gazette on 18.05.2010, the ceiling limit of gratuity was enhanced from Rs.3.5 lakhs to Rs.10.00 lakhs with effect from 24.05.2010. 143 Since the petitioners were retired prior to 24.05.2010, they are not entitled to the enhanced gratuity of Rs.10.00 lakhs under the provisions of the 1972 Act. B. The petitioners were members of recognised trade unions of respondent No.3. For the purpose of wage revision for unionised employees who were on the rolls of respondent No.3 as on 01.01.2007, the unions submitted their Charter of Demands relating to wages and allied matters. Negotiations were held pursuant thereto. One of the demands pertained to service gratuity. The relevant demand reads as follows:

Gratuity Act should be amended ensuring at least one month’s salary for each completed year of service and ceiling on maximum amount should be suitably increased to ensure higher amount (Rs.10.00 lakhs) with effect from 01.01.2007.

144 After negotiations and intervention of Conciliation Officers and the Deputy Chief Labour Commissioner, Bengaluru, the parties arrived at a settlement as per the Memorandum of Settlement dated 24.01.2011, duly signed by the representatives of the Management and the recognized unions of all divisions of the third respondent under Section 12(3) read with Section 18(3) of the Industrial Disputes Act,

1947. The settlement clearly records that the demand relating to enhancement of the ceiling limit of gratuity was rejected by the Management. Other benefits were extended and accepted by the unions. Accordingly, the retired employees of the third respondent were paid gratuity of Rs.3.5 lakhs, which was accepted by the petitioners. Pursuant to the settlement, a General Bulletin was issued on 24.01.2011. Since settlement was arrived at under Section 18(3) of the ID Act, it has statutory force. It is binding on both the 145 employer and employee. Therefore, the petitioners cannot seek enhancement of the gratuity amount contrary to the settlement. (i) It is well settled by a catena of decisions of the Apex Court that a settlement entered into between the employer and the recognised trade union is binding on the parties and carries statutory force. The Apex Court, in Barauni Refinery Pragatisheel Shramik Parishad v.

Indian Oil Corporation Limited, reported in (1991) 1 SCC 4, has categorically held settlements are enforceable in law and bind not only the parties to the settlement but also the workmen represented by the union. (ii) The said legal position has been reiterated in K.C.P. Limited v. Presiding Officer and Others, reported in (1996) 10 SCC 446, wherein the Apex Court observed that settlements arrived at in the 146 course of collective bargaining cannot be lightly ignored and are binding in nature. (iii) Once again, in Transmission Corporation of A.P. Ltd. and Others v. P. Ramachandra Rao and Another, reported in (2006) 9 SCC 623, the Apex Court affirmed that settlements entered into under the Industrial Disputes Act have statutory sanctity and are binding on all concerned, unless set aside in accordance with law. In view of the above judgments, it is very clear that settlement is binding on both the petitioner and the respondent No.3.

Therefore, petitioners cannot seek enhancement of ceiling of gratuity contrary to the settlement. C. The Government of India, Ministry of Heavy Industries and Public Enterprises, Department of Public Enterprises issued an Office Memorandum dated 26.11.2008 regarding service benefits, enhancing the ceiling limit of gratuity from Rs.3.5 147 lakhs to Rs.10.00 lakhs with effect from 01.01.2007. This benefit was extended to Board-level and below Board-level Executives and non-unionised Supervisors in Central Public Sector Enterprises. It is not applicable to workmen, much less unionised workmen such as the petitioners. Therefore, the contention of the petitioners that the benefit under the Office Memorandum dated 26.11.2008 should also be extended to them is untenable. D. Workmen and executives stand on different footings insofar employment remuneration are concerned. The service conditions of workmen are governed by the Standing Orders framed under the Industrial Employment (Standing Orders) Act, 1946, whereas executives are governed by the Service Rules of respondent.

The remuneration of workmen is determined through long- term settlements arrived at by negotiations with 148 registered and recognised unions in accordance with the provisions of the Industrial Disputes Act. The tri- partite Memorandum of Settlement signed between the Management and the unions before the competent authority is binding on the parties. Therefore, the contention of the petitioners that workmen and officers of the third respondent stand on the same footing and that denial of enhanced gratuity to workmen amounts to violation of Article 14 of the Constitution of India cannot be accepted. Workmen and officers constitute two distinct classes. The petitioners, being members of recognised unions, entered into a settlement with the Management and accepted gratuity of Rs.3.5 lakhs upon retirement. Hence, their claim for enhancement of the gratuity ceiling is unsustainable. In similar circumstances, High Court of Delhi in the case of SAIL EX-EMPLOYEES ASSOCIATION (supra) held that employees who are 149 workmen constitute altogether different class from the Managers and Officers.

The relevant paragraphs are extracted below: “2. Another grievance of the Petitioner is that the ceiling on gratuity is applicable only to those employees who are in executive cadre and there is no ceiling in case of non-executive employees. The Petitioners have sought setting aside of the lower ceiling fixed by SAIL and have further sought removal of distinction between executives non-executive employees in the matter of gratuity. They have also sought payment of difference in gratuity amount along with interest at the rate of 24 per cent per annum.

3. The Petition has been contested by the Respondent-Steel Authority of India Limited. It has been stated in the Counter Affidavit that Respondent No. 1 is an independent Company having its own policy and rules for its employees and is not a department of Government of India and, therefore, the decisions of Government of India in respect of Government employees are not 150 applicable to it. It has been further alleged that as per Clause 3.2.1 of SAIL Gratuity Rules, the amount of gratuity in respect of employees governed by the Memorandum of Agreement, arrived at in the National Joint Committee for Steel Industry, is to be decided as per the terms of the agreement. Even the fixation of salary and other benefits in respect of the non- executives is based on the agreement arrived at National Joint Committee for Steel Industry. The Memorandum of Agreements signed at the National level are implemented by entering upon by-partite settlement at the plant/unit level with the local management and local Union representing the non-executives and the workmen. The Memorandum of Agreement of Joint Wage Negotiating Committee for Steel Industries which was signed in October, 1970, provided that there shall be no ceiling or limit on the amount of gratuity payable. In all subsequent NJCS Agreements, it has been provided that the benefits given under the previous Agreements will continue and, therefore, upper limit on payment of gratuity has become non-operative in case of non- executive employees. 151

4. It has also been alleged by the respondent Executives Officers/Managers at various levels are different and distinct class, compared to non- executives who constitute workmen. It has also been pleaded that since promotions from non-executives posts to executives post were accepted by the members of the Petitioner- Association, at the terms and conditions applicable to the executives, they are stopped from raising a grievance on this count. It has also been stated that Executive enjoys several benefits and allowances which are not available to non-executives and there cannot be any comparison since the two are distinct class categories. It has further been stated in Counter Affidavit that vide Government of India Ordinance dated 24.9.1997, under Payment of Gratuity Act, the amount of ceiling was increased from Rs. 1 lakh to Rs.2.5 lakh further vide Payment of Gratuity (Amendment) Act, 1998 dated 23.6.1998, the ceiling was raised to Rs.3.5 lakh. The Rules of the Company were amended accordingly so as the ceiling the date of amendments. 152

5. Let me first take up the grievance of the petitioners regarding distinction between executives and non-executives in the matter of payment of gratuity. Section 4(2) of the Payment of Gratuity Act, 1972 provides that for every completed year of service or part thereof in excess of six months, the employer shall pay gratuity to an employee at the rate of 15 days wages based on the rate of wages last drawn by the employee concerned. Sub- section (5) of Section 4 before its amendment with effect from 24.9.1997, provided that the amount of gratuity payable to an employee shall not exceed Rs. 1 lakh. It was increased first to Rs. 2.5 lakh and then to Rs. 3.5 lakh. The ceiling of Rs.3.5 lakh was prescribed by Payment of Gratuity (Amendment) Act, 1998, with effect from 24th September, 1997. Therefore, as far as Section 4(4) of Payment of Gratuity Act, 1972 is concerned, the upper ceiling was Rs.1 lakh prior to 24th September, 1997, which was fixed at Rs.3.5 lakh with effect from 24.9.1997.

6. Section 4(5) of the Payment of Gratuity Act, 1972 reads as under: 153 “Nothing in this section shall affect the right of an employee to receive better terms of gratuity under any award or agreement or employer.” contract with

Thus, despite the upper ceiling prescribed by Sub-section (4), the employees are entitled to receive higher gratuity if it is so agreed under any award or an agreement or contract between the employer and employees.

As disclosed in the counter affidavit, the salary and other benefits of non-executive employees of Steel Industry were fixed under an agreement arrived at the level of National Joint Committee for Steel Industry, which was followed by by-partite agreement at plants/unit level between the local management and the local unions representing the workmen. The counter affidavit shows that a Memorandum of Agreement Joint Wage Negotiating Committee for steel industry signed in October, 1970 provided that there was to be no ceiling or limit on the amount of gratuity payable. It further shows that in all subsequent NJC's agreements, it was provided that the benefits provided under the previous agreement would 154 continue. Thus, in view of the agreement between the respondent and its workmen, there is no ceiling on the amount of gratuity payable to the non-executive employees and such an agreement is specifically permitted by Section 4(5) of the Payment of Gratuity Act,

9. It is true that differential treatment is being meted out by the respondent/SAIL to its employees forming part of the executive cadres and the employees who are non- executives/workmen. But, such a differential treatment is not without authority of law and is expressly permitted under Section 4(5) of the Payment of Gratuity Act, 1972. The Constitutional validity of Section 4(5) of Payment of Gratuity Act, 1972 has not been challenged by the petitioners. They have also not challenged the agreement between the respondent and its non-executive employees. So long as there is a subsisting agreement between the respondents and its non-executive employees to the effect that there will be no ceiling on the gratuity payable to the workmen and such an agreement is permissible in law, no fault can be found with the respondent 155 treating its employees forming part of executive cadres differently employees who are workmen, in the matter of Payment of Gratuity.

Even otherwise, the employees who are workmen, constitute an altogether different class from the employees who are Managers and Officers, being members of various executive cadres of the respondent/Company. The pay structure, allowances and service conditions of employees forming part of managerial/officer cadres altogether different from the pay structure, allowances service conditions employees constituting non-executive cadres. Those who belong to executive cadres get not only higher salary but also better allowances, more perks and more favourable service conditions. In fact, executive cadres and non-executive cadres are altogether different classes and cannot be compared with each other. Differential treatment based on intelligible differentia is permissible under the Constitution so long as it has a reasonable nexus with the objective sought to be achieved in this behalf. Only those who are similarly situated are 156 entitled to equal treatment. Since employees forming part of managerial cadres belong altogether to a different class, they cannot claim, as a matter of right, the same treatment which is given to the non-executive employees on account of a binding agreement between them and the respondent company. Therefore, this is no violation of Article 14 of the Constitution in payment of gratuity to the executives as per their statutory entitlements while paying gratuity to the non-executives in terms of the agreement between them and the management.” (i) The Apex Court in the case of STATE OF UTTARAKHAND vs. SUDHIR BUDAKOTI AND OTHERS reported in (2022) 13 SCC 256 has held that a mere differential treatment on its own cannot be termed as an anathema to Article 14 of the Constitution of India. The relevant paragraphs are extracted below: “14. A mere differential treatment on its own cannot be termed as an “anathema to Article 157 14 of the Constitution”. When there is a reasonable basis for a classification adopted by taking note of the exigencies and diverse situations, the Court is not expected to insist on absolute equality by taking a rigid and pedantic view as against a pragmatic one.

Such a discrimination would not be termed as arbitrary as the object of the classification itself is meant for providing benefits to an identified group of persons who form a class of their own. When the differentiation is clearly distinguishable with adequate demarcation duly identified, the object of Article 14 gets satisfied. Social, revenue and economic considerations certainly permissible parameters in classifying a particular group. Thus, a valid classification is nothing but a valid discrimination. That being the position, there can never be an injury to the concept of equality enshrined under the Constitution, not being an inflexible doctrine.

A larger latitude in dealing with a challenge to the classification is mandated on the part of the Court when introduced either by the Legislature or the Executive as the case may 158 be. There is no way, courts could act like appellate authorities especially when a classification is introduced by way of a policy decision clearly identifying the group of beneficiaries by analysing relevant materials.

The question as to whether a classification is reasonable or not is to be answered on the touchstone of a reasonable, common man's approach, keeping in mind the avowed object behind it. If the right to equality is to be termed as a genus, a to non- discrimination becomes a specie. When two identified groups are not equal, certainly they cannot be treated as a homogeneous group. A reasonable classification thus certainly would not injure the equality enshrined under Article 14 when there exists an intelligible differentia between two groups having a rational relation to the object. Therefore, an interference would only be called for on the Court being convinced that the classification causes inequality among similarly placed persons. The role of the court being restrictive, generally, the task is best left the authorities concerned. When a classification is made on the recommendation 159 made by a body of experts constituted for the purpose, Courts will have to be more wary of entering into the said arena as its interference would amount to substituting its views, a process which is best avoided.

As long as the classification does not smack of inherent arbitrariness and conforms to justice and fair play, there may not be any reason to interfere with it. It is the wisdom of the other Wings which is required to be respected except when a classification bordering on arbitrariness, artificial difference and itself being discriminatory. A decision made sans the aforesaid situation cannot be tested with either a suspicious or a microscopic eye. Good faith and intention are to be presumed unless the contrary exists. One has to keep in mind that the role of the Court is on illegality involved as against governance.

For the aforesaid principle of law, we would like to quote the elucidations of this Court in the following judgments:

19.1.Transport & Dock Workers Union v. Mumbai Port Trust [Transport & Dock Workers 160 Union v. Mumbai Port Trust, (2011) 2 SCC 575 : (2011) 1 SCC (L&S) 566] : (SCC pp. 587-90, paras 36-37, 39-41, 43-44 & 48) “36. Differential treatment in our opinion does not per se amount to violation of Article 14 of the Constitution. It violates Article 14 only when there is no conceivable reasonable basis for the differentiation. In the present case, as pointed out above, there is a reasonable basis and hence in our opinion there is no violation of Article 14 of the Constitution.

In our opinion it is not prudent or insist on for the Court to pragmatic absolute equality when there are diverse situations and contingencies, as in the present case. In view of the inherent complexities involved in modern society, some free play must be given to the executive authorities in this connection. ***

In our opinion, there is often a misunderstanding about Article 14 of the Constitution, and often lawyers and Judges tend to construe it in a doctrinaire and absolute sense, which may be totally impractical and make the working of the executive authorities extremely difficult if not impossible.

As Lord Denning observed: ‘This power to overturn executive decision must be exercised very carefully, because you have got to remember that the executive and the local authorities have their very own responsibilities and they have the right to make decisions. The 161 courts should be very wary about interfering and only interfere in extreme cases, that is, cases where the court is sure they have gone wrong in law or they have been utterly unreasonable. Otherwise you would get a conflict between the courts and the Government and the authorities, which would be most undesirable. The courts must act very warily in this matter.’ [See Judging the World : Law and Politics in the World's Leading Courts by Garry Sturgess, Philip Chubb (Butterworths, 1988).]”

In our opinion Judges must maintain judicial self-restraint while exercising the powers of judicial review of administrative or legislative decisions. “In view of the complexities of modern society”, wrote Justice Frankfurter, while Professor of Law at Harvard University,

and the restricted scope of any man's experience, tolerance and humility in passing judgment on the worth of the experience and beliefs of others become crucial faculties in the disposition of cases. The successful exercise for rare of such judicial power calls intellectual in personal penetration, experience and imagination operate as the Constitution. These limitations of insights Mr Justice Holmes applied hundreds of cases and expressed memorable language : It is misfortune if a Judge reads his conscious or unconscious sympathy with one side or the other prematurely into the law, and forgets that what seem to him to be first principles are believed by half his fellow men to be wrong.

In our opinion adjudication must be done within the system of historically validated conscious minimisation of the Judges' preferences. The Court must not embarrass administrative authorities and must realise expertise in the field of administration while the Court does not. In the words of Chief Justice Neely, former Chief Justice of the West Virginia Supreme Court of Appeals: administrative authorities stockbroker ‘I have very few illusions about my own limitations as a Judge. I am not an accountant, electrical engineer, financer, banker, system management analyst. It is the height of folly to expect Judges intelligently to review a 5000 page intricacies of a public utility operation. It is not the function of a Judge to act as a super board, or with the zeal of a pedantic school master substituting its judgment for that of the administrator.’ record addressing

In administrative matters the Court should, therefore, ordinarily defer to the judgment of the administrators unless the decision is clearly violative of some statute connection, Frankfurter while Professor of Law at Harvard University wrote in The Public and its Government: shockingly arbitrary. Justice In ‘With the great men of the Supreme Court constitutional adjudication has always been statecraft. As a mere Judge, Marshall had his superiors among his colleagues. His supremacy lay in his recognition of the practical needs of the Government. The great Judges are those to whom the Constitution is not primarily a text for 163 interpretation but the means of ordering the life of a progressive people.’ ***
