The deceased is none other than the wife of the petitioner. It is alleged that the deceased picked up a quarrel as the petitioner had illicit relation with other women. In the said quarrel, the petitioner slapped the deceased and when she became unconscious, the petitioner put a towel into her mouth and pressed her neck forcibly with the pillow and murdered her. The post mortem report reveals that the death is due to respiratory failure consequent to homicidal smothering. The incident has taken place in the house of the accused. 3

Considering the circumstances, I find that, it is not a fit case for grant of bail. Accordingly, the petition is dismissed. Sd/- JUDGE
