JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioners seek the following relief: "WHEREFORE, the petitioners above named humbly pray that this Hon'ble Court may be pleased to quash the entire charge sheet filed in CC No.24749/2024 pending on the file of the XXIV Addl. CJM, Bangalore for the offences under Sections 498A, 323, 504, 506 IPC and 4 DP Act, (Cr. No.195/2023) respondent Basavangudi Women's Police Station, in the interest of justice." filed by first the 2. All parties along with their respective counsel are physically present before the Court and would submit that the matter has been settled between them. The learned counsel for the petitioners has also filed an application IA.2/2025 for compounding, which reads as under: "APPLICATION UNDER SECTION 482 R/W SECTION 320 Cr. P. C. FOR COMPOUNDING The petitioners and the second respondent above named states as under. 1. The first petitioner is the son and the fourth petitioner is the daughter of the second and the - 4 - NC: 2025:KHC:24532 CRL.P No. 5582 of 2025 HC-KAR third petitioners. That petitioners are living at Ahmednagar. 2. The marriage of the first petitioner with second respondent was solemnised on 22/12/2018 at Bengaluru and that they have lived together at Ahmednagar not continuously and thereafter the second respondent has left the matrimonial home permanently and has been living at Bengaluru since 06/07/2020. It was the second marriage of the first petitioner and also that of the second respondent. 05/07/2020 though till 3. That the second respondent had filed a petition for divorce in M C No.1422/2021 and for maintenance in Cr. Misc. No.384/2021 on the file of the II Addl. Family Court, Bengaluru and Cr. Misc. No.104/2022 under the D V Act before the MMTC III, Bengaluru. 4. The petitioners state that the dispute between the first petitioner and the second respondent has now been settled before the Family Court by mediation on 18/03/2025 in MC No.1422/2021 whereby the first petitioner and the second respondent have been granted divorce, subject to the first petitioner paying a permanent alimony of Rs.38,50,000/- (Rs.Thirty Eight Lakhs Fifty Thousand) and out of which a sum of Rs.13,50,000/- (Rs. Thirteen Lakhs Fifty Thousand) was paid on 22/07/2024, Rs.20,00,000/- (Rs. Twenty Lakhs) was paid on 20/03/2025 by cheque and the balance amounts to Rs.5,00,000/- (Rs. five Lakhs) is payable on the withdrawal of the CC No.24749/2024 filed by the second respondent. 5. In view of the above settlement, the second respondent has withdrawn Cr. Misc. No.384/2021 on the file of the II Addl. Family Court, Bengaluru filed against the first petitioner and Cr. Misc. No.104/2022 under the D V Act before the MMTC III, Bengaluru filed against the petitioners. - 5 - NC: 2025:KHC:24532 CRL.P No. 5582 of 2025 HC-KAR 6. The first petitioner has this day paid the balance payment of Cheque Rs.5,00,000/- (Rs. Five Lakhs) by Cheque No.557087 dt. 07/07/2025 drawn on Punjab National Bank in full and final settlement. 7. The petitioners and the second respondent state that in view of the settlement arrived at between them, the second respondent hereby withdraws all the allegations and states that she is not interested in pursuing with the complaint and or prosecuting the complaint the petitioners anymore and hence this Hon'ble Court may be pleased to grant permission to compound the offences and quash the complaint in CC No.24749/2024 pending on the file of the XXXVII Addl. CJM, Bangalore, in the interest of justice. in CC No.24749/2024 against 8. The respondent will not be prejudiced by the the present application petitioners would be put to great hardship and suffer irreparable loss and injury. if allowed, whereas WHEREFORE, the petitioners and the second respondent humbly pray that in view of the existing circumstances, this Hon'ble court may be pleased to permit them to COMPOUND and QUASH the entire proceedings in CC No.24749/2024 pending on the file of the XXXVII Addl. Decision

ORDER (i) The petition is disposed of; and (ii) The proceedings in C.C.No.24749/2024 (arising out of Crime No.195/2023 of 1st respondent – Police) registered for the offences punishable under Sections 498A, 323, 504 and 506 of IPC and Section 4 of Dowry Prohibition Act, pending on the file of the XXIV Additional Chief Judicial Magistrate, Bangalore, insofar as the petitioners are concerned are hereby quashed.
