Issue A Writ Of Certiorari to Quash the Impugned Order Bearing No.HD 57 PCE 2024 BENGALURU Dated 15.06.2024 passed by the 1st respondent vide Annexure- J to the Writ Petition ii. Issue a Writ Of Certiorari to Quash the Impugned Orders Bearing No.HE.SA.NI(THO-PA)/PR/16/2024-25 Dated 19.06.2024 and Order Bearing No. HE.SA.NI(THO- PA)/PR/41/2024-25 Dated 19.06.2024 passed by the 5th and 6th respondent Vide Annexure-K & L respectively iii. Heard Sri Abhijeet, learned counsel for petitioner, Sri Shamanth Naik, learned High Court Government Pleader for respondent No.1 and Sri Naveen Chandrashekar, learned counsel for respondent Nos.2 to 6. - 4 - NC: 2025:KHC:17267 WP No. 8526 of 2025 3. Facts in brief, germane, are as follows: Respondent No.5 issues a notice inviting tender on 19.01.2022, for procurement of manpower services - security services on contract basis. The petitioner is declared to be the successful bidder, on account of him being declared as L1. Respondent No.5 issued two separate work orders on 01.07.2022, to commence the work from 01.07.2022 to 30.06.2023. Agreements were also entered into between the petitioner and respondent No.5 on 01.07.2022. The petitioner is said to have submitted representation for extension of the period of work orders, which were issued in favour of the petitioner. The issue in the lis does not relate to the conditions of tender, or the tender. The issue in the lis relates to blacklisting of the petitioner. Blacklisting has emerged on account of the alleged fake ‘Pasara Certificate’ said to have been submitted by the petitioner. Blacklisting of the petitioner is what has driven him to this Court in the subject petition. 4. Learned counsel appearing for the petitioner submits that the petitioner prior to him being blacklisted on whatever ground, he was not heard in the matter. He would contend that the order is in violation of the principles of natural justice. - 5 - NC: 2025:KHC:17267 WP No. 8526 of 2025 5. Learned counsel for respondent Nos.2 to 6 would submit on verification of the records that notices were issued to the petitioner and the same were returned as ‘unclaimed’. This itself is enough to indicate that the notices were issued and would be in compliance with principles of natural justice is his submission. He would seek dismissal of the petition. 6. I have given my anxious consideration to the submissions made by the learned counsel for the respective parties and have perused the material on record. 7. The afore-narrated facts are not in dispute. The issue now lies in a narrow campus, whether the petitioner was heard prior to passage of the impugned orders of blacklisting the petitioners. The reason for blacklisting is that, he has allegedly submitted a fake ‘Pasara Certificate’. The references found in the afore- - 8 - NC: 2025:KHC:17267 WP No. 8526 of 2025 quoted orders would not indicate that the petitioner has submitted any reply to the show cause notice. In the document dated 30.07.2024 it stops only upto the show cause notice so issue to the petitioner, dated 22.07.2024. 8. As observed hereinabove, learned counsel for respondent Nos.2 to 6 submits that the notice was dispatched but not served upon the petitioner for the reason that it was returned unclaimed. In that light, there is admittedly violation of the principles of natural justice. In the case at hand, the petitioner has not been given opportunity to submit his reply to the allegations prior to passage of the blacklisting order, which undoubtedly entails serious civil and economic consequences upon the person, against whom the blacklisting order is passed. 9. The blacklisting order could not have been passed at the outset without compliance with the principles of natural justice. In that light, I deem it appropriate to read down the impugned order dated 30.07.2024 as a show cause notice and direct the petitioner to submit his reply. - 9 - NC: 2025:KHC:17267 WP No. 8526 of 2025 10. Therefore, for the aforesaid reasons, the following: ORDER a. The writ petition is disposed. b. The impugned order dated 30.07.2024, is read down as a show cause notice. c. The petitioner is permitted to reply to this show cause notice within 3 weeks from today and the respondents shall consider the reply in accordance with law and pass necessary orders within 3 weeks thereafter. d. All consequential actions taken pursuant to the impugned order would be kept in abeyance, till the decision is taken on the reply given by the petitioner as observed hereinabove. e.
