NARENDRA PRASAD ORAL ORDER This writ petition is filed under Article 227 of the Constitution of India, seeking the following reliefs:
Issue a writ in the nature of mandamus directing the Hon’ble Principal Civil Judge and JMFC Sidlaghatta dispose IA No.2 O.S.No.124/2024 vide Annexure-B within time bound as this Hon’ble Court deem fit to grant and further necessary orders may kindly be passed to meet the ends of justice.
2. In view of the nature of the relief sought in this writ petition, notice to the respondents is dispensed with.
The plaintiff/Respondent No. 1 herein filed a suit for permanent injunction. During the pendency of the suit, the petitioner herein filed IA No.2 under Order 1 Rule 10(2) of CPC seeking permission to implead as a defendant in the suit. The said application was filed on - 3 - NC: 2025:KHC:17501 WP No. 7188 of 2025
06.07.2024. The plaintiff has already filed objections to the said application. So far, the application has not been disposed of. Therefore, the petitioner is before this Court seeking for early disposal of IA No.2.
In view of the above, without expressing any opinion on the merits of the case, the trial court is directed to dispose of IA No.2 filed by the petitioner herein, as expeditiously as possible, not later than six months from the date of receipt of a copy of this order.
