16.02.2024 passed in Execution No.17/2020 by the I Addl. Senior Civil Judge, Bengaluru Rural District, Bengaluru. When the matter was posted before this Court on 07.03.2024, the following order was passed: “Heard learned counsel for the petitioner as well as learned counsel for the caveator – respondents 1 and 2. Learned counsel for the petitioner on instructions submit that the petitioner would pay a sum of Rs.25 lakhs to the - 3 - NC: 2024:KHC:12075 WP No. 7187 of 2024 respondents 1 and 2 – Decree holders on or before
21.03.2024. It is made clear that in the event the petitioner does not pay a sum of Rs.25 lakhs to the respondents 1 and 2 on or before 21.03.2024, the present petition would stand dismissed without further orders from the Court. Re-list on 22.03.2024. In the meanwhile, all further proceedings Ex.No.17/2020 pending on the file of I Addl. Senior Civil Judge, Bangalore Rural District, Bangalore, are hereby stayed till next date of hearing. Liberty is reserved in favour of respondents to seek vacation / modification of this order. Hand delivery of this order is permitted.”
2. Even till today, the aforesaid order has not been complied with by the petitioner. Under these circumstances, in the light of the aforesaid order dated 07.03.2024 passed by this Court, I am left with no option but to dismiss the present petition without interfering with the impugned order.
