#1. Accused No.5 in Crime No.10 of 2025 registered by Kuderu Police Station, Chamarajanagar District for offences punishable under Sections 4 and 5 of Explosive Substances Act, 1908, Section 9B(1)(b) of Explosive Act, 1884 and Section 325 of BNS, 2023 is before this Court in this petition filed under Section 482 of BNS, 2023 seeking anticipatory bail.

#3. Heard the learned counsel for the parties. FIR in Crime No.10 of 2025 was registered by Kuderu Police Station, Chamarajanagar District aforesaid offences against unknown persons. Apprehending arrest on the said case, petitioner had filed Crl. Misc.No.518 of 2025 before the jurisdictional Sessions Court, which was rejected on 16.12.2025. Therefore, he is before this Court.

Perusal of the material on record would go to show that, accused nos.1 and 2 in the present case have been granted anticipatory bail by the Co-ordinate bench of this Court in Criminal Petition No.12669 of 2025 connected with Criminal HC-KAR - 3 - NC: 2026:KHC:40148 CRL.P No. 1433 of 2026 CNR: KAHC010062242026 Petition No.12643 of 2025 disposed of on 22.09.2025. Under similar circumstances the petitioner had approached this Court in Criminal Petition No.1421 of 2026 seeking anticipatory bail in Crime No 9 of 2025 registered by the very same police station with similar allegations. The said petition has been allowed by this Court on 02.06.2026 and in paragraph no.4 of the said order, it is observed as follows:- "In the complaint lodged on 28.01.2025 by Gurusiddaih, he has stated that his cow, which was left out for the purpose of grazing had suffered injury to its mouth and other parts of the body. The injuries were allegedly caused by an explosion that occurred while the cow was eating the fodder, in which explosive substance was kept by unknown person. It is under these circumstances, FIR in Crime No.9/2025 was registered by Kuderu Police Station, Chamarajanagar. Accused Nos.1 and 2 in the said case have been granted anticipatory bail by co-ordinate Bench Court Crl.P.No.12669/2025 c/w Crl.P No.12643/2025 on the ground that they have been arrayed as accused only on suspicion and there was no material to connect them to the crime. Even as against the petitioner, there is no other material to connect him to the crime and only on suspicion he has been arrayed as accused. Undisputedly, he is not a person HC-KAR - 4 - NC: 2026:KHC:40148 CRL.P No. 1433 of 2026 CNR: KAHC010062242026 with any criminal antecedent and he is an agriculturist by avocation".

#5. Under the circumstances, the following:- ORDER (i) The Criminal Petition is allowed. (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.10 of 2025 registered by Kuderu Police Station, Chamarajanagar District for offences punishable under Sections 4 and 5 of Explosive Substances Act, 1908, Section 9B(1)(b) of Explosive Act, 1884 and Section 325 of BNS, 2023, subject to the following conditions:-

#1. The Petitioner shall appear before Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. (c) Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon.
