These petitions are filed by accused Nos.1 to 5 under Section 482 of Cr.P.C, to quash the criminal proceedings in C.C.No.14814/2021, for the offences punishable 498A & 506 r/w Section 34 of I.P.C and Sections 3 and 4 of Dowry Prohibition Act. 3. A compromise petition is filed under Section 320 r/w 482 of Cr.P.C., supported by joint affidavit of accused No.1 and respondent No.2/complainant, a copy of - 5 - NC: 2025:KHC:21609 CRL.P No. 911 of 2022 C/W CRL.P No. 8687 of 2021 HC-KAR memorandum of settlement filed in M.C.No.1660/2023 is also produced. It is submitted that matter is settled for a sum of Rs.25 lakhs and out of it today before this Court respondent No.2/complainant report the receipt of Rs.10 lakhs and remaining payment would be made before the Family Court in M.C.No.1660/2023. 4. The terms and conditions of settlement arrived at between the parties reads as under: "The Petition is filed by the complainant/ Respondent No. 2 and the Petitioner/ Accused in the above said case. 2. The said case has been charge sheet against the petitioner/accused under Section 498A, 34, 506 of IPC and Section 3 & 4 of the Dowry Prohibition Act. 3. It is submitted that the matters related to the case in hand has been settled and compromised between the parties in the presence of mediators/ counsels in M.C No. 1660/2023 before the I Addl. Prl. Judge, Family Court at Bangalore. Copy of the same is produced along with this petition. 4. It is submitted that as per the settlement agreed before the Bangalore Mediation Centre, the - 6 - NC: 2025:KHC:21609 CRL.P No. 911 of 2022 C/W CRL.P No. 8687 of 2021 HC-KAR Petitioner herein has drawn a Demand Draft, in the name of 2nd respondent, dated 19.06.2025 bearing DD No. 002052, for a sum of Rs.10,00,000.00/- (Rupees Ten Lakhs Only) and the same is handed over to the 2nd respondent today. 5. It is submitted that the balance amount of Rs. 15,00,000.00/-(Rupees Fifteen Lakhs Only), agreed as per the settlement agreement will be honored by the Petitioner within closure of the M.C No. 1660/2023 before the I Addl. Prl. Judge, Family Court at Bangalore. 6. It is submitted that if any of the conditions as mentioned in this compromise petition are not met, the said cases may be restored. 7. It is submitted that there is no fraud or undue influence in arriving at this compromise". 5. Respondent No.2/complainant admit the compromise and submits that she has no objection to allow the petitions. The terms and conditions of compromise petition are legal and equitable. Decision
ORDER (i) The petitions filed under Section 482 Cr.P.C, are allowed. (ii) The entire proceedings in C.C.No.14814/2021 (Crime No.116/2020) on the file of VI Additional Chief Metropolitan Magistrate, Bengaluru, is hereby quashed.
