Learned counsel for the petitioner taking this Court through the petition averments and the documents enclosed therein, submits that a suit in O.S.No.701/2024 filed by the petitioner herein against the private respondent for relief of partition and separate possession of various properties which have been notified by the respondent-Karnataka Industrial Areas Development Board (for short 'KIADB') for the purpose of acquisition. He further submits that the application was made in - 6 - NC: 2025:KHC:2810 WP No. 887 of 2025 the said suit to implead respondent-KIADB as a party- defendant which is allowed upon the no objection indicated by the private respondent herein. 3. He further contends that by suppressing the aforesaid facts in the matter, respondent Nos.4 to 6 had filed the petition in W.P.No.34733/2024 before this Court without making the petitioner a party and obtained the direction against respondent-KIADB to consider the representation for release of compensation in their name. He submits that respondent Nos.4 to 6 ought to have brought to the notice of this Court with regard to impleadment of respondent-KIADB in the suit as defendant party and without reference to that fact, an order came to be passed by this Court. He further submits that the order which is passed by this Court in the said writ petition is causing impediment in the disposal of the application before the Trial Court wherein the petitioner has now filed application for an order seeking disbursement of the compensation amount. 4.

Decision

4. With this observation, the Writ Petition is disposed of." Admittedly, respondent-KIADB has been impleaded as party defendant in the said suit in O.S.No.701/2024. Petitioner herein has also made an application seeking disbursement of compensation amount in the said suit which is pending consideration. - 8 - NC: 2025:KHC:2810 WP No. 887 of 2025 5. Learned counsel for the private respondents submits that they would appear before the Trial Court in O.S.No.701/2024 and pursue the remedy. 6. In view of the aforesaid peculiar facts and circumstances, the Writ Petition is allowed since the petitioner has filed an application before the Addl. Senior Civil Judge, Nelamangala in O.S.No.701/2024. The same shall be considered in accordance with law. 7. Respondent-KIADB shall not disburse the amount till consideration of the application filed by the petitioner in O.S.No.701/2024 before the Addl. Senior Civil Judge, Nelamangala. SD/- (M.G.S.
