JUSTICE ANANT RAMANATH HEGDE ORAL ORDER This petition is filed assailing the conviction and sentence in C.C. No.1092/2018 on the file of the Additional Chief Metropolitan Magistrate SCCH-6, Bengaluru City. In terms of conviction and sentence dated 17.09.2022 the accused is convicted for an offence under Section 138 of Negotiable Instruments Act, 1881 (for short 'Act, 1881') and is sentenced to pay fine of Rs.5,05,000/- and in default of payment of fine, sentenced to undergo simple imprisonment for six months. Out of the fine amount, Rs.5.00 lakhs is ordered to be paid as compensation to the complainant and Rs.5,000/- is ordered to be forfeited towards the expenditure of the State.

An application is filed which bears the signature of the learned counsel for the petitioner, learned counsel for the respondent and the complainant. Along with the application, another memo is also enclosed which is signed by the complainant and the accused which was the settlement recorded on 05.05.2025. It is stated that payment was not made in terms of settlement dated 05.05.2025. Accordingly, the settlement is entered on 19.09.2025 modifying the terms as indicated in the application dated 19.09.2025.
It recorded the application complainant has agreed to receive Rs.4,50,000/- towards the full and final settlement of his claim and he has acknowledged the receipt of Rs.1.00 lakh paid in cash on 05.05.2025 as recorded in the memo dated 05.05.2025.

The petitioner/accused has agreed to pay Rs.1,50,000/- on or before 10.10.2025. It is also recorded that in case of default on the part of the petitioner to pay the amount agreed, sentence passed by the Trial Court and confirmed by the Appellate Court stands revived.

This Court has perused the terms and conditions of the joint application. Accordingly, the joint application is accepted.
The impugned judgment dated 21.12.2024 passed by the LXII Sessions Judge (CCH-63), Bengaluru in Criminal Appeal No.1256/2022 so also the judgment dated 17.09.2022 passed by the Additional Chief Metropolitan Magistrate, Bengaluru in C.C.No.1092/2018 are modified in terms of the joint application.
