2. It is the contention of the petitioners that the petitioner's husband filed an application seeking regularisation - 3 - NC: 2026:KHC:6292 WP No. 473 of 2026 HC-KAR of unauthorised occupation of 1 acre and 18 guntas of land in Sy.No.87 of Yennagere Village, Soluru Hobli, Magadi Taluk, Ramanagara District. Accordingly, an official memorandum was issued on 27.01.2004 regularising the unauthorised occupation in favour of the petitioner's husband. It is contented that a sketch has been prepared demarcating the lands granted in favour of several persons including the petitioner's husband. However, till date saguvali chit has not been issued and the name of the petitioners who are the legal heirs of late Sri. Narasimhamurthy have not been entered in the revenue records.
3. The prayer in the petition is to issue a writ of mandamus directing respondent No.3-Tahsildar, Magadi Taluk, to issue saguvali chit in favour of the petitioner's husband. The counsel further prays that directions be issued to the respondent-Tahsildar to enter the name of the petitioners in the revenue records.
Operative part
The writ petition stands disposed of with a direction to respondent No.3 – Tahasildar, Magadi Taluk to consider the representations given by the petitioners at - 4 - NC: 2026:KHC:6292 WP No. 473 of 2026 HC-KAR Annexures-D, F and G dated 18.04.2007, 12.07.2016 and
24.10.2024, verify the records and find out whether Sri. Narasimhamurthy S/o late Gangaiah was indeed granted the land. If it is found that the Committee had in fact regularised the land in favour of Sri. Narasimhamurthy, the Tahasildar shall proceed to pass necessary orders issuing Saguvali chit and proceed to collect kimmath from the petitioners. Once the kimmath has been paid and Tahsildar has satisfied himself with respect to the grant made in favour of the petitioner's husband Sri. Narasimhamurthy he shall proceed to enter his name in the land records pursuant to the issuance of the Saguvali chit. Subsequent to that the Tahsildar shall look into the aspect of the legal heirs of Sri. Narasimhamurthy and after verifying the same he shall proceed to enter the names of the petitioners and any other legal heir as may be required in accordance with law. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of - 5 - NC: 2026:KHC:6292 WP No. 473 of 2026 HC-KAR three months from the date of receipt of a copy of this order. Ordered accordingly.
