Being aggrieved and dissatisfied with the award dated 06.09.2022 passed by the competent authority for land acquisition under National Highways Act, 1956, the petitioners have filed an application for making reference before the concerned Collector for apportionment of the compensation. It is the grievance of the petitioners that the application is not being disposed of by the learned Collector in accordance with law and this has constrained the petitioners to approach this Court.

Operative part

Having regard to the nature of controversy involved and the relief prayed for, this petition is disposed of, at this stage, by directing the Deputy Commissioner, Kathua, who is competent authority under Section 3(a) of the National Highways Act, 1956, to dispose of the reference request of the petitioners made vide application dated 12.09.2023 in accordance with law within a period of four weeks. The Deputy Commissioner shall ensure that till application of the petitioners is decided either way, amount of compensation is disbursed to anybody.
