1. It has been brought to the notice of this Court by Mr. Pranav Kohli, learned senior counsel appearing on behalf of the petitioners in the lead case and other connected matters that all the petitions have been rendered infructuous with the efflux of time in the light of the fact that the Government of Jammu and Kashmir, through Industries and Commerce Department has issued Order No. 43-IND of 2019 dated 01.03.2019 pursuant to the State Administrative Council Decision No. 68/7/2019 dated 28.02.2019, In the light of Jammu and Kashmir State Industries Policy 2016 whereby, all the petitioners are complying the stipulation as envisaged in Clause III of aforesaid Government order and thus he has the instructions not to press all these petitions as there is no grouse at present.
2. In the aforesaid backdrop, the statement of Mr. Pranav Kohli, Sr. Advocate is taken on record along with Govt. Order mentioned supra. He seeks withdrawal of these writ petitions except OWP No. 1204/2013.
3. For facility of reference, the said Government order, is reproduced as under: i. The minimum level of local employment by the industrial units shall continue to be 55% reckoned from date of production of the unit. ii. The endeavour would be to reach minimum 75% local employment in the next five years from the date of production to avail all incentives under the State package under the State Industrial Police, 2016. iii. In order to encourage and enable industries to move from 75% to 90% local employment in five more years, the state would further provide the following incentives: a) 25% concession in lease rent. 26 OWP No. 674/2018 Along with connected matters b) Training assistance Government institutions. through State training under iv. The units shall however engage apprentices mandatorily Apprenticeship Training Scheme of Technical Education Department of Government of Jammu and Kashmir controlled and regulated by the Apprentices Act, 1961 so as to create a pool of skilled workforce Industrial units. for employment v. Any industrial unit having total employees less than or equal to 15 (fifteen) shall be kept out of purview of this order.
4. In light of the statement made by learned senior counsel for the petitioners, all these clubbed petitions, except OWP No. 1204/2013, are dismissed having rendered infructuous along with all connected applications.
5. Registry is directed to detach OWP No. 1204/2013 and list again on
05.02.2024.
