JUSTICE SANJEEV KUMAR, JUDGE ORDER 24.02.2022 On the last two consecutive dates of hearing, there was no representation on behalf of the petitioner. Today also, when the case was called out, nobody turned up to appear for the petitioner. It appears that the petitioner is no more interested to pursue this petition Otherwise also, the petitioner in this petition is seeking a direction to the respondents to register an FIR against respondent Nos. 4 and 5 for illegally demolishing the structure of the petitioner on spot. Needless to say that Code of Criminal Procedure contains enough provisions for registering an FIR. Unless the petitioner exhausts that procedure, he cannot be permitted to come straight to the High Court by invoking the extraordinary jurisdiction of this Court vested under Article 226 of Constitution of India. This petition is, otherwise, misconceived and deserves to be dismissed. Ordered accordingly. 2 OWP No. 1944/2015 However, a liberty is granted to the petitioner to approach the concerned authorities for addressing his grievance as per the provisions of Code of Criminal Procedure.
