O R D E R 28.02.2025 Impugned in this petition filed under Article 226 of the Constitution of India is an interim order dated 27th January 2025 passed by Central Administrative Tribunal, Srinagar Bench [“the Tribunal”] in OA No. 43/2025 titled Raies Ahmad Mir vs. Home Department. Impugned order is challenged by the petitioner primarily on the ground that the order is tantamount to rejecting the interim relief. We have gone through the impugned order and are of the considered opinion that the order impugned is only an order issuing notice to the respondents both in the main as well as in the application for interim relief. The Tribunal has deferred the consideration of the application for interim relief till the objections are filed by the affected respondents. Be that as it may, in view of the fact that the application for interim relief is yet to be decided by the Tribunal, as such, we do not deem it appropriate to show any indulgence at this stage. The petition is, therefore, not maintainable and the same is accordingly dismissed. Needless to say that subject to the affected respondents entering their appearance and filing objections, the application of the petitioner for interim relief shall be considered by the Tribunal on the date fixed i.e., 26th March 2025.
