#1. Impugned in this appeal, filed under Clause 12 of Letters Patent by the appellants, is an order dated 18.12.2024 passed by the learned 2 LPA No. 5/2025in WP (C) No. 2968/2024 Single Judge of this Court [“the Writ Court”] in WP (C) No. 2968/2024 titled Kashmir Valley Energy Pvt. Ltd. & Anr. Vs. Union Territory of J & K & Ors.

From the reading of the impugned order dated 18.12.2024, it clearly transpires that the Writ Court has not decided any issue of fact or law on merits and, therefore, the order dated 18.12.2024 cannot be said to be a judgment amenable to challenge under Clause 12 of the Letters Patent. The Writ Court has only directed the Respondent No. 2 to provide requisite instructions to the Respondent No. 3 in light of the plea raised by him in his communication dated 05.12.2024.
#3. We are sure that in compliance with the impugned order dated
18.12.2024, the Respondent No. 2 shall communicate the final decision in the matter to the Respondent No. 3 within one week from the date, copy of this order is served upon him. With the aforesaid observations, this appeal is dismissed along with connected application(s), if any.
