The petitioner apprehending his arrest in connection with Maheshpur P.S. Case No.105 of 2024 registered under Sections 318(4)/319(2) of Bharatiya Nyaya Sanhita, 2023, Sections 30/56 of Indian Veterinary Council Act, 1984 and Section 34 of National Medical Commission Act, 2019, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. It has been alleged that the petitioner for last 10-12 years had been illegally running a private veterinary hospital equivalent to the Government Veterinary Hospital at village-Ghanshyampur and village-Sonarpara and used to treat different animals without getting any registration number/certificate issued by Indian Veterinary Council, New Delhi as well as Jharkhand Veterinary Council, Ranchi. It has further been alleged that the petitioner had also departmental Cryocan 3 LIT-1 PC and artificial insemination kits which he was not returning to the concerned department and was also not providing monthly progress report related to insemination to the department for almost two years.

It is further submitted that the petitioner is a diploma holder and trained in artificial insemination who also worked under government scheme for a long time but no satisfactory remuneration was paid to him due to which he left the departmental work of artificial insemination (A.I.). The petitioner has been implicated in this case to pressurize him to collect report about A.I. and submit the same. Otherwise also, the allegation made in the F.I.R. is unfounded. Under the said circumstance, the petitioner may be given the privilege of anticipatory bail.

Learned A.P.P. opposes the petitioner’s prayer for grant of anticipatory bail.

Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail.

Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Pakur in connection with Maheshpur P.S. Case No.105 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Vikas/ (Rajesh Shankar, J.) -2- A.B.A. No.7581 of 2024
