The instant civil misc. petition under Article 226 of Constitution of India has been filed for restoration of W.P.(S) No. 6863 of 2013, which stood dismissed for non-prosecution on 27.04.2017.
The instant restoration application has been filed on 03.09.2021, after lapse of more than four years, however, the Court is not satisfied with the explanation as explained in this petition.
Considering the aforesaid fact, this Court is of the view that after such an inordinate delay, the instant civil miscellaneous petition is not fit and proper to restore W.P.(S) No. 6863 of 2013.
