The petitioners are seeking a direction upon the respondent- Jharkhand Education Project Council to regularize their services and treat them at par with the regular employees working in the Jharkhand Education 5 Project Council. Further prayer has been made to command upon the respondents to abide by the service conditions enshrined in the “Bihar Shiksha Pariyojna Parishad Regulations, 1994” which was adopted by the Jharkhand Education Project Council for the purpose of continuation / discontinuation of the contract of the employees like the petitioners. 3. At the very outset, learned counsel appearing for the respondents

disposed of on 16.8.2019, wherein, this Court held that petitioners could not claim any vested or enforceable legal right to claim regularization in JEPC on the basis of contractual appointment and that too solely on the basis of scheme. Learned counsel further submits that thereafter the matter fell for consideration before the Division Bench of this Court in L.P.A. No. 858 of 2019 (Nazir Ahmad & ors. Vs. State of Jharkhand & Ors.) decided on 8.8.2023, whereby the Division Bench of this Court has been pleased to affirm the order passed by the Writ Court in W.P.(S) No. 3477 of 2022. 4. So far as the second prayer for implementation of Bihar Shiksha Pariyojna Parishad Regulations, 1994 is concerned, Mr. Krishna Murari, learned counsel representing the respondents submits that already the said Regulations, 1994 is adopted by the State of Jharkhand and the same is not applicable to the case of contractual employees, rather, it is only applicable to the regular employees. The present petitioners being contractual employees shall not be guided by the said Regulations, 1994 and hence, it is a fit case for no interference by this Court. 5. Having heard the learned counsel for the parties and having gone through the materials available on record, this Court is of the view that no interference is warranted in the present writ petition. The issue regarding regularization of contractual employees working in Jharkhand Education Project Council fell for consideration before a coordinate Bench of this Court in W.P.(S) No. 3477 of 2002 and after hearing the parties, the Court declined to interfere therein. The relevant paragraph reads as under:- “14. Having heard the counsel for the parties, this court finds that the appointment of the petitioners was on fully 6 its taking into consideration contractual basis and the appointment letter in this regard speaks for itself. It is admitted fact that the petitioners are working with the JEPC under a scheme. The scheme is being funded by the Government of India in which a small amount is being contributed by the State Government. JEPC are within their jurisdiction to take a decision whether the petitioners service can be regularized or not. That decision can only be taken by the JEPC as per the financial requirement conditions and other relevant factors. It also needs to be looked into that the petitioners could not claim any vested or enforceable legal right to claim regularization in JEPC on the basis of contractual appointment and that too solely on the basis of scheme. Para-53 of the State of Karnataka Vs. Uma Devi (s) (2006) 4 SCC 1 will not help the petitioners because, they were appointed on the basis of a scheme which is clearly depicted in appointment letter and accordingly, would come to an end and the closure of scheme by JEPC. The petitioners were not appointed on a duly stationed vacant post. In that view of the matter, Para- 53 of Uma Devi (3) will not come to aid of the petitioners. The prayer for regularization is not made with Government of Jharkhand rather it is made with JEPC and how the JEPC work has been dealt (supra). Any direction by this court at this stage may come in the way and break the terms of providing education by the State.” 6. Thereafter, the order was challenged before the Division Bench of this Court in L.P.A. No. 858 of 2019, wherein the Division Bench held that the issue of legal vested right of the contractual engagee has been taken consideration which led the learned Single Judge not to pass any positive direction, which according to our considered view cannot be said to suffer from any error and thereby rejected the appeal. So far as the second prayer is concerned, it is not in dispute that the same is not applicable with reference to the contractual employees and hence, the petitioners are not entitled for the same. 7.
