JUSTICE GAUTAM KUMAR CHOUDHARY For the Petitioners For the State Oral Order : Mr. Binod Kumar Dubey, Advocate Mr. Arvind Prajapati, Advocate : Mr. Jitendra Pandey, A.P.P. 03/ Dated : 16.09.2022 The anticipatory bail application filed on behalf of petitioners, who are apprehending their arrest in connection with Complaint Case No. 510 of 2021 for the offence registered under Sections 498A, 323, 34 of the Indian Penal Code pending in the Court of learned Additional Chief Judicial Magistrate, Lohardaga, is pressed into motion. As per the prosecution case, marriage took place in the year 2021 and thereafter she was subjected to cruelty. It is alleged that on 13.09.2021, her husband pronounced triple talak. It is submitted by the learned counsel on behalf of the petitioners that no date or time of any assault or harassment has been stated in the complaint petition. The allegations are general and omnibus. Learned A.P.P. has opposed the prayer for bail. Considering the submissions made, the anticipatory bail application is allowed. Accordingly, the petitioners, above named, are directed to surrender before the learned Trial Court within a period of two weeks and in the event of their arrest or surrender, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties of the like amount each to the satisfaction of the Court below, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
