The petitioners are accused in a case registered under Sections 307/328 of the Indian Penal Code. It reveals from the complaint that some poisonous substance was administered to the complainant by his wife Sinku Devi. It is further alleged that these petitioners, who are brothers of Sinku Devi, were having in connivance with Sinku Devi. It is submitted that relation between the spouses were strained from before and Sinku Devi has already lodged a case u/s 498A I.P.C. against the complainant. In this case too, the police after completing investigation has submitted Final Form stating the occurrence untrue. On the basis of protest petition cognizance has been taken against these petitioners and other accused Sinku Devi. This case has been lodged only with a view to create pressure to settle the dispute prevailing between the spouses. Learned counsel appearing for the complainant submitted that these petitioners hatched out conspiracy with Sinku Devi and after that poison was administered to the complainant. Be that as it may, these petitioners were not present at the time when poisonous substance was alleged to have been administered to the complainant. Considering all these aspects, above named petitioners are directed to surrender before the Court below within a period of four weeks from today and on such surrender they are directed to be released on bail on furnishing bail bond of Rs.10,000/(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Court of Sri Syed Salim Fatmi, learned Civil Judge, Junior DivisionIII, Koderma in connection with Complaint Case No.300 of 2012 subject to the conditions laid down under Section 438(2) Cr.P.C.
