JUSTICE SANJAY KUMAR DWIVEDI ----- For the Petitioner For the State : Mr. Manish Yadav, Advocate : Mr. Prabir Kumar Chatterjee, Spl.P.P. ----- 05/22.08.2025 The petitioner is apprehending his arrest in connection with Itkhori P.S. Case No.59/2025, registered for the offence under Sections 303(2)/ 317(5)/ 3(5) of the BNS and Section 4/21 of MMDR Act, 1957 and Rule 4/54 of the JMMC Rules, pending in the Court of the learned Additional Chief Judicial Magistrate, Chatra.

Learned counsel for the petitioner submits that the allegations are made that 30 CFT sand was loaded on the tractor. He submits that the petitioner is the owner of the seized tractor. He further submits that the petitioner is not having any criminal antecedent, as disclosed in paragraph 10 of this application.

Learned counsel for the State opposed the prayer and submits that the sand was being carried illegally.

Considering that the petitioner is the owner of the seized tractor and he has got no criminal antecedent and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra in connection with Itkhori P.S. Case No.59/2025, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Ajay/ (Sanjay Kumar Dwivedi, J.)
