This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Section 317(5) of the Bharatiya Nyaya Sanhita (B.N.S.), 2023 , under Section 21 of M.M.D.R. Act 1957, Rule 54 of Jharkhand Minor Mineral Concession Rules, 2004 and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation & Storage) Rule, 2017 in connection with Harla P.S. Case No.27 of 2025, pending in the Court of learned Judicial Magistrate 1st Class, Bokaro.
Learned counsel for the petitioner admits that petitioner has responded with the notice under Section 41-A of Cr.P.C.
If that be so, this Court is of the opinion that there is no apprehension of the petitioner being arrested, thus, this anticipatory bail application at this stage is misconceived.
Petitioner should appear before the Court concerned.
