Petitioners are apprehending their arrest in connection with Complaint Case No. 105/2019, registered under Sections 420/ 467/ 468/ 120B and 504 of the Indian Penal Code, pending in the Court of learned C.J.M., Chatra. It is alleged that parties had entered into an agreement to exchange their land. It is further alleged that the complainant had transferred his land in the name of the petitioner but the petitioner has subsequently refused to honour the agreement on his part. It was submitted that petitioners had purchased the land of opposite party No.2. Sale deed by which the complainant has transferred his land to the petitioners goes on to reveal that they had purchased the land after paying the consideration amount of Rs. 2 lakhs. It is nowhere mentioned in the sale deed that the complainant was transferring his land on the basis of agreement of exchange of land between the parties. Regard being had to the facts and circumstance of the case, I am inclined to extend the privilege of Anticipatory Bail to the petitioners. They are directed to surrender before the court below within two weeks from the date of receipt of copy of this order and learned court below on their surrender shall release them on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five Thousand only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Chatra in connection with Complaint Case No. 105/2019, Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
