JUSTICE GAUTAM KUMAR CHOUDHARY ----- For the Petitioner For the State : Mr. Rahul Pandey, Advocate : Mr. Suraj Verma, A.P.P. ----- ----- Oral Order 04/ Dated : 27.06.2022 The anticipatory bail application filed on behalf of petitioner, namely, Anwar Quraishi @ Sikandar Quraishi, who is apprehending his arrest in connection with Bashishthnagar PS Case No. 88 of 2018 for the offence registered under Sections 4(a)(b)(c) & 12 (i)(ii) of the Prevention of Cruelty to Animal Act and Section 12(1)(2)(3) of the Jharkhand Bovine Animal Prohibition of Slaughter Act, 2005, pending in the Court of learned C.J.M., Chatra is pressed into motion. Heard the parties. It is submitted by the learned counsel for the petitioner that neither he has concern with the seized animals nor anything has been recovered from his possession. It further submitted that only allegation is that he was following the cattle with his motorcycle. It is also submitted that he has got no any criminal antecedent. The learned APP opposed the prayer for anticipatory bail. Considering the submissions of the learned counsels and the facts as discussed above, the anticipatory bail application is allowed. Hence, in the event of his arrest or surrender within a period of four weeks from the date of this order, the petitioner named above shall be released on bail on depositing Rs.25,000/- as cash security money on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, subject to the conditions laid down under section 438 (2) Cr. P.C. The petitioner will cooperate in the investigation and will appear on notice under Section 41A of Cr.P.C and comply with the condition as laid down under Section 438(2) of the Cr.P.C.
