CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI For the Petitioner --- :- None. For the State :- Mr. Prabir Kr. Chatterjee, Advocate 02/15.05.2024 On repeated calls, nobody has responded on behalf of the ---- petitioner. Learned counsel for the respondent State is present.

The petitioner is apprehending his arrest in connection with Karra P.S. Case No. 24 of 2024, for the offence registered under Sections 414 of the Indian Penal Code, Section 4/21 of Mines and Minerals (Development and Regulation) Act, 1957, Rule 54 of the Jharkhand Minor Minerals Concessions Rules, 2004 and Rule 7/9/13 Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rules, 2017 pending in the Court of learned SDJM, Khunti.

It is averred in the petition that petitioner is the owner-cum- driver of the Hywa in question and the petitioner has got no criminal antecedent as disclosed in paragraph No.16 of the petition and further allegations are there that 700 cft sand was loaded.

Learned counsel appearing for the State opposed the prayer on the ground that illegally the sand was loaded on the said hywa. A.B.A. No. 2459 of 2024 --1--

Considering that the petitioner is the driver-cum-owner and he has got no criminal antecedent as disclosed in paragraph No.16 of the petition, I am inclined to provide privilege of anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned SDJM, Khunti, in connection with Karra P.S.
