The petitioners have filed this writ application for granting the benefits by way of 2nd ACP w.e.f. 09.08.1999 in the pay scale of Rs.8,000- 13,500/- with grade pay of Rs.5400/- along with other prayers. 3. The petitioners were appointed on the post of police inspector on various dates, which has been mentioned at Annexure-1 of this writ application. After 24 years of service, the petitioners were granted 2nd ACP. However, the petitioners were granted pay scale of Rs.7500/- to 12,000/- instead of pay scale of Rs.10,000/- to 15,200/- which the petitioners are claiming in the present writ application. 4. Learned counsel appearing on behalf of the respondents-State submitted that pay scale of Rs.10,000/- to 15,200/- was payable to Dy. S.P. and certain percentage of post of Dy. S.P. has been reserved for promotion from the post of inspector. As promotion to the post of inspector is considered to be fresh appointment, the petitioners cannot be given benefit of the pay scale of Rs.10,000/- to 15,200/-. It was submitted that one of the ground for refusing the aforesaid pay scale of Dy. S.P. was that on promotion, there was change of cadre. 5. The financial benefits are extended to the employees who are not accorded promotion to alleviate any frustration on their part and any condition to be imposed, while granting the financial up gradation is contrary to the settled principle of law. Financial upgradation is granted to the employees eligible for promotion but are not promoted in due course of time. The financial up gradation is also granted in case, where the person is eligible for promotion but due to want of any vacant post on the next promotional post, the person is not promoted and no condition can be imposed for willful financial up gradation to the persons who are eligible for promotion on the next promotional post. 6. In view of the aforesaid discussion, the office letter dated No.12/10.01.2020 is quashed. The respondents are directed to extend the -5- benefit of 2nd ACP to the petitioners within four months from the date of receipt of this order in accordance with law. 7. This writ application is allowed.
