Singh, Advocate For the Resp.-JEPC: Mr. Krishna Murari, Advocate --- 06 / 01.08.2024 Petitioners have filed these writ applications for quashing of the Letter No. PED/04/40/2014/Part-I/490 Ranchi dated 28.02.2019 (Annexure-10), issued by the Respondent No. 4 - Director, Rajya Pariyojna, Jharkhand Shiksha Pariyojna Parishad, Jharkhand, whereby and wherein, all the District Education Officer-cum-District Programme Officer, Samagra Shiksha Abhiyan, Jharkhand were directed to reduce the existing pay and allowances of the petitioners who were working as Data Entry Operator at Block Level. 2. Petitioners were appointed as Data Entry Operator on contractual basis in the year 2011 on emoluments of Rs. 8,536/- and subsequently, their pay was increased @ 50% after every three years and thereafter, it was increased @ 20% after every three years and in the year 2019, they were getting more than Rs. 15,000/-. However, vide impugned order (Annexure-10), Respondent- Director, Rajya Pariyojna, Jharkhand Shiksha Pariyojna Parishad, Jharkhand of Jharkhand reduced their emoluments at Rs. 15,000/- per month. 3. It was submitted on behalf of the petitioners that the Respondent have reduced their emoluments in a very arbitrary and discriminatory manner and the emoluments which the petitioners were getting after working for about 10 years, cannot be reduced in such a manner. 4. Learned counsel appearing on behalf of the Respondent State submits that the order reducing emoluments of the petitioners was passed at the instance of the Union of India. 10. 5. Mr. Krishna Murari, learned counsel appearing on behalf of the Respondent Jharkhand Education Project Council (JEPC) submitted that the petitioners were given option to accept reduction in their emoluments at the time of renewal of their contract which they had accepted. 6. Mr. Anil Kumar, learned Additional Solicitor General of India, appearing on behalf of Union of India, submits that the Union of India has not issued any direction to the State Government for reduction of emoluments of the petitioners and this fact has been mentioned in their counter affidavit. 7. Reduction of emoluments of the petitioner after working for 10 years appears to be against the principles of natural justice and settled principle of law. 8. Accordingly, petitioners are directed to file fresh representation before the Respondent-Secretary, School Education and Literacy Department, Government of Jharkhand and the Respondent-Director, Rajya Priyojna, Jharkhand Shiksha Pariyojna Parishad, Government of Jharkhand agitating their claim, which shall be disposed of by the concerned Respondents by passing reasonable order within two months from the date of production/receipt of this order. 9.
