It appears from the fardbeyan that some altercation took place between the informant party and the accused party on account of filling of soil on the road situated near the house. It is alleged that the petitioner caught hold of the informant and his brother Nasim caused assault to him by means of iron road on his head. It is submitted that all the male members of the family have been implicated in this case. There is case and counter case between the parties. The order giver accused Sultan Ansari has been granted bail by this Court vide A.B.A. No.1439 of 2013. Learned counsel appearing for the State opposed the prayer for bail. Admittedly, assailant Nasim is not the petitioner at present and the case of this petitioner stand on similar footing than that of accused Sultan Ansari, who has already been granted anticipatory bail by this Court. In the aforesaid circumstances, above named petitioner is directed to surrender before the Court below within a period of three weeks from today and on such surrender he is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Chief Judicial Magistrate, Pakur in connection with Pakur (T) P.S. Case No.39 of 2013 corresponding to G.R. Case No.126 of 2013 subject to the conditions laid down under Section 438(2) Cr.P.C. NKC (D. N. Upadhyay, J.)
