The instant writ application has been preferred by the petitioner praying for a direction upon the respondent authorities to appoint the petitioner on the post of Chowkidar in Thakurgangti P.S. after voluntary retirement of his father from the post of Chowkidar in the same P.S under the district of Godda in view of the provisions enshrined under the Bihar Chowkidar Manual; inasmuch the father of the petitioner had nominated the name of the petitioner for such appointment after his voluntary retirement.

At the outset, learned counsel for the petitioner submits that though the petitioner has represented the concerned respondent, but no decision has been taken till date. 1

Learned counsel for the respondents submits that let the petitioner file a fresh petition before the respondent no. 7, so that a decision can be taken.

Having regard to the aforesaid facts and circumstances and the submissions made at bar, the instant writ application is hereby disposed of by directing the respondent no. 4 to treat this writ petition as representation and take a decision in the matter by passing a reasoned and speaking order within a period of 12 weeks from the date of receipt of such representation and any such decision shall be communicated to the petitioner. Further petitioner is directed to serve the copy of this writ application to the respondent no. 4 at the earliest.
