Srivastava, A.P.P. 04/12.07.2023 Heard the parties. ---- Petitioner is apprehending his arrest in connection with Bhandariya P.S. Case No. 66/2022, for the offences under Sections 376, 313, 484 of the Indian Penal Code, pending in the court of Sri Krishna Lohra, learned Judicial Magistrate,1st Class, Garhwa. The prosecutrix is a widow lady aged about 37 years. She entered into consensual physical relationship with the petitioner on the promise of marriage. Both the petitioner and the prosecutrix lived together for about 2 ½ years. It is alleged that subsequently petitioner refused to marry her, accordingly, this case was instituted. Learned A.P.P. has opposed the prayer for Anticipatory Bail. The parties were in live in relationship for a prolong period of time. Regard being had to the facts and circumstance of the case, I am inclined to enlarge the petitioner on anticipatory bail. He is directed to surrender before the court below within two weeks from the date of receipt of copy of this order and learned court below on his surrender shall release him on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five Thousand only) with two sureties of the like amount each to the satisfaction of Sri Krishna Lohra, learned Judicial Magistrate,1st Class, Garhwa or his successor in connection with Bhandariya P.S. Case No. 66/2022. Subject to the conditions as laid down under Section 438 (2) Cr.P.C. Jay/- (Ambuj Nath, J.)
