26.6.2013: The petitioner is an accused in a case registered under Sections 384, 418, 420 and 120B I.P.C. There is allegation in the complaint that accused persons after hatching out a conspiracy, prepared fake muster roll to get payment against filling of soil and morum on the road. When the complainant could learn about the above fact, he has lodged this case. It is submitted that no demand was made, nor the petitioner had received any payment. Learned counsel, appearing for the State has opposed the prayer. It appears that the main allegation is against Sunita Devi who is not the petitioner at present. Considering facts and circumstances, as indicated above, the petitioner, named above, is directed to surrender in the court below within three weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Dhanbad, in connection with C.P. Case No. 2256 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. MK (D.N. Upadhyay, J.)
