The petitioner is apprehending her arrest in connection with Tongra P.S. Case No. 14 of 2023, registered under sections 341, 323, 325, 307, 34 of I.P.C. and under section 3/4 of Witch Craft (Daain) Act, 2001, pending in the Court of learned Judicial Magistrate, Ist Class, Dumka.

Learned counsel for the petitioner submits that the petitioner has bene mechanically made an accused in the present case and there is no allegation of assault against the petitioner and the allegation is made against one Panmuni Soren. He submits that the petitioner has no criminal antecedent which is disclosed in para 14 of the petition.

Learned counsel for the State opposes the prayer on the ground that the petitioner is named in F.I.R. and she was present at the place of occurrence.

Considering that allegation of assault is not against the petitioner and she has no criminal antecedent which is disclosed in para 14 of the petition, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named petitioner is directed to surrender before the learned court within three weeks from today and in the event of her surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of the learned Judicial Magistrate, Ist Class, Dumka, in connection with Tongra P.S. Case No. 14 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure and the petitioner will not change her mobile number which is indicated in her Aadhar.
