Tiwari, A.P.P -------- 04/ Dated 22.04.2022 Heard the parties. The petitioner has been made an accused in connection with Cyber P.S. Case No. 11 of 2021, Cyber Case No.02 of 2022, for the offence under Sections 467, 419, 420, 468, 120B of the Indian Penal Code and Sections 66C and 66D of the I.T. Act, pending in the court of Sri Arvind Kumar Pandey, learned Additional Judicial Commissioner-II, Ranchi. The informant was contacted by petitioner for payment of money against his lapsed Life Insurance Policy. He was lured in depositing money in his account and subsequently, Rs.24,45,223/- was transferred from the account of informant to the account of this petitioner. Mr. A. K. Kashyap, learned senior counsel for the petitioner has submitted that petitioner is ready to deposit the transferred amount, subject to the final decision of the case. Regard being had to the facts of the case, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Arvind Kumar Pandey, learned Additional Judicial Commissioner-II, Ranchi, in connection with Cyber P.S. Case No. 11 of 2021, Cyber Case No.02 of 2022, subject to the condition that the petitioner will deposit a bank draft of Rs.8,00,000/- in the name of the informant at the time of furnishing of his bail bond, which shall be handed over to the informant after due verification and proper identification. Subsequently, petitioner will deposit the remaining amount within six months from the date of his release again by way of bank draft in the name of the informant, which shall be handed over to the informant after due verification and proper identification. If the petitioner fails to comply with the order of this Court, learned court below shall cancel his bail and take him into custody without further reference to this Court. BS/ (Ambuj Nath, J.)
