This bail application has been filed on behalf of the abovenamed applicant with prayer to release on bail in connection with Saraiyahat P.S. Case No.228 of 2015 registered under Sections 452, 341, 342, 366, 506/34 of the Indian Penal Code pending in the court of learned Additional Chief Judicial Magistrate, Dumka. Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged by the informant against the accused Lalu Kumar Yadav and five unknown miscreants with these allegations that on 9th November, 2015, six miscreants came by the three motorcycles and all began to assault to his father and uncle as well and they also abducted the wife of the informant. With the utter belief that it was Lalu Kumar Yadav who had threatened him few days back to abduct his wife, this F.I.R. was lodged against him and five unknown miscreants. Learned counsel for the applicant has submitted that the name of the applicant does not figure in the F.I.R., rather it transpired during investigation. The victim was recovered and her statement under Section 164 Cr.P.C. was also recorded. Though the victim has named Pritam Yadav, yet no T.I.P. was conducted to identify his complicity in commission of the alleged offence. The applicant has been languishing in jail since 25.11.2021. No one appears on behalf of the State to oppose the present bail application. In view of the submissions made and materials on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
