Sukhram Kujur @ Sukhram Oraon v. The State of Jharkhand

Digvijay Singh posted at Raidih Police Station that three persons were apprehended at the spot from whose possession arms and ammunitions were recovered but their companion have succeeded to flee away. On interrogation, the apprehended accused disclosed the names of their associates including the name of Sukram Oraon. It is submitted that petitioner is not Sukhram Oraon rather his name is Sukhram Kujur and he has no concern with the persons apprehended or absconded from the place of occurrence. He has furnished all his identity and address, which has been verified and now it is clear that he is not said Sukhram Oraon, who absconded from the place of occurrence. Learned Counsel for the State concedes the facts on the basis of the materials collected in paragraph 43 of the case diary. In the aforesaid facts and circumstances of the case, the petitioner is directed to surrender before the court below within three weeks from today and if he does so he shall be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of like amount each to the satisfaction of Sri Md. Umar, Judicial Magistrate, 1st Class, Gumla in connection with Raidih P.S. Case No. 08 of 2012, corresponding to G.R.No. 120 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. P.K.S. [D.N.Upadhyay,J.]
