Decision
All the writ petitions are under Article 226 of the Constitution of India seeking therein the following prayers; A. “To issue an appropriate writ, order or direction declaring Rule 3 of the Mines and Minerals (Contribution to District Mineral Foundation) Rules, 2015 framed by the Central Government (Ministry of Coal) as substituted vide Rule 1 of the Mines and Minerals (Contribution to District Mineral Foundation) Amendment Rules, 2016 ultra vires the provisions of the Miners and Mineral (Development and Regulation) Act, 1957, particularly, Section 9B thereof as also Articles 14, 19(1)(g) and 265 of the Constitution of India;” B. “To issue an appropriate writ, order or direction in the nature of mandamus or any other writ, order or direction of like nature directing the Respondents not to enforce Rule 3 of the Mines and Minerals (Contribution to District Mineral Foundation) Rules, 2015 as substituted vide Rule 1 of the Mines and minerals (Contribution to District Mineral Foundation) Amendment Rules, 2016;” C. “To issue a writ, order or direction in the nature of certiorari or any other writ, order or direction of like nature quashing the Letter dated 03.11.2016 issued by Respondent no.3; D. “To issue an appropriate writ, order or direction in the nature of mandamus or any other writ, order or direction of like nature directing the Respondents to refund the amount already realised from the petitioners, without any notice/ knowledge of the petitioners, from the advance deposit lying in their credit with the Respondents for the period 07.12.2015 to 31.03.2016.” 2. It appears from the order dated 27.02.2017 that all the matters have been listed together and accordingly the matter has been heard time to time 50 together by the Co-ordinate Benches. 3. It has been contended on behalf of the writ petitioners by referring to the order passed by the Co-ordinate Benches dates 12.04.2017 whereby and whereunder the matter was adjourned sine-die awaiting for the outcome of the pending matter before the Hon'ble Apex Court in the case of Federation of Indian Mineral Industries & Ors. vs. Union of India & Anr. reported in (2017) 16 SCC 186. 4. It has been contended that the aforesaid issue has finally been decided by the Hon'ble Apex Court in the said case as reported in (2017) 16 SCC 186. 5. The learned counsel for the writ petitioners have submitted that since the matter has finally been decided and as such these writ petitions may finally be disposed of in terms of the judgement passed by the Hon'ble Apex Court in the case of Federation of Indian Mineral Industries & Ors. vs. Union of India & Anr. reported in (2017) 16 SCC 186. 6. Further submission has been made that this Court has also decided similar issues in the case of M/s. Usha Martin Limited vs. State of Jharkhand & Ors. which was decided while disposing of the writ petition in W.P.(C) No. 6624 of 2016 on 01.03.2023. Further submission has been made by declarations of the orders passed by the Co-ordinate Bench in W.P.(C) No. 6824 of 2016 with W.P.(C) No. 6825 of 2016 which has been decided on 21.08.2023. Learned counsel for the writ petitioners has submitted that since the issue has already been decided by the Hon'ble Apex Court in the case of Federation of Indian Mineral Industries & Ors. vs. Union of India & Anr. reported in (2017) 16 SCC 186, wherein the ratio has been laid down regarding the issue of demand to be raised from the date of notification to be issued by the appropriate Government. Herein the notification has been issued in pursuance to the Rule under Challenge i.e. Rule 3 of Mines and Minerals (Contribution to District Mineral Foundation) Rules 2015 on 17.09.2015 so far it relates to the non-coal industries are concerned and 15.09.2015 so far it relates to the coal industries are concerned. The Co-ordinate Bench of this Court by taking into consideration the aforesaid aspect of the matter and basing upon the judgement passed by the Hon'ble Apex Court in Federation of Indian Mineral Industries & Ors. vs. Union of India & Anr. reported in (2017) 16 SCC 186 has quashed the respective demand notices issued by the Central Coal fields Limited as 51 would appear from the order passed in the case of M/s. Usha Martin Limited vs. The State of Jharkhand & Ors. [W.P. (C) No. 6624 of 2016] decided on 01.03.2023 and W.P.(C) No. 6824 of 2016 with W.P.(C) No. 6825 of 2016 decided on 21.08.2023. 7. Learned Additional Solicitor General of India is present and has submitted that all the writ petitions needs to be disposed of in terms of the order passed by the Hon'ble Apex Court in Federation of Indian Mineral Industries & Ors. vs. Union of India & Anr. reported in (2017) 16 SCC 186 as also the orders passed by the Co-ordinate Division Benches of this Court in the case of M/s. Usha Martin Limited vs. The State of Jharkhand & Ors. [W.P. (C) No. 6624 of 2016] decided on 01.03.2023 and W.P.(C) No. 6824 of 2016 with W.P.(C) No. 6825 of 2016 decided on 21.08.2023. 8. Similar argument has been advanced on behalf of the learned counsels appearing for the Central Coal Fields Limited and the State of Jharkhand. 9. We after having heard the learned counsel for the parties and taking into consideration the fact that the issue has already been decided by the Hon'ble Apex Court in Federation of Indian Mineral Industries & Ors. vs. Union of India & Anr. reported in (2017) 16 SCC 186. Relevant paragraphs of the case is from paragraph 52 onwards, for ready reference the same is being referred herein below. “52. Having considered the issues raised by the petitioners and by the learned Additional Solicitor General in different perspectives, we hold: 52.1. Merely because the DMFs have been established or are deemed to have been established from a date prior to the issuance of the relevant notifications does not make their operation retrospective. 52.2. In any event, the establishment of the DMFs (assuming the establishment is retrospective) from 12-1- 2015 does not prejudicially affect any holder of a mining lease or a prospective licence-cum-mining lease. 52.3. In view of the failure of the Central Government to prescribe the rate on 12-1.2015 at which contributions are required to be made to the DMF, the contributions to the DMF cannot be insisted upon with effect from 12-1-2015. Fixing the maximum rate of contribution to the DMF is 52 insufficient compliance with the law laid down by the Constitution Bench in Vatika. (CIT Vs. Vatika Township (P) Ltd. (2015) 1 SCC 1) 52.4. Contributions to the DM Fs are required to be made by the holder of a mining lease or a prospective licence- cum-mining lease in the case of minerals other than coal, lignite and sand for stowing with effects from 17-9-2015 when the rates were prescribed by the Central Government. 52.5. Contributions to the DMF are required to be made by the holder of a mining lease or a prospecting licence- cum-mining lease in the case of coal, lignite and sand for stowing with effect from 20-10-2015 when the rates were prescribed by the Central Government or with effect from the date on which the DMF was established by the State Government by a notification, whichever in later. 52.6. The Notification dated 31-8-2016 issued by the Central Government is invalid and is struck down being ultra vires the rule-making power of the Central Government under the MMDR Act. 53. We fervently hope the State Governments recognise their responsibilities and utilise the contributions to the District Mineral Funds quickly and for the object for which they have been established, particularly since the amounts involved are huge. 54. We grant time till 31-12.2017 to those holders of a mining lease or a prospecting licence-cum-mining lease who have not made the full contribution to the District Mineral Funds to pay the contributions, failing which they will be liable to make the contribution with interest at 15% per annum from the due date. We also make it clear that in the event any older of a mining lease or a prospecting licence-cum-mining lease has mistakenly made contributions to the District Mineral Fund from a date prior to the date that we have determined, such a holder of a mining lease or a prospecting licence-cum- 53 mining lease shall not be entitled to any refund but may adjust the contribution against future contributions, without the benefit of any interest. 55. With the above conclusions. Transfer Petitions Nos. 74-76 of 2017 are allowed. Transferred Cases [arising out of Transfer Petition (C) Nos. 74-76 of 2017]. Transferred Cases (C) Nos. 43 and 51 of 2016 and the batch of petitions are disposed of. All other pending applications are also disposed of.” 10. Further, we on consideration of the judgement passed by the Co-ordinate Division Bench in W.P. (C) No. 6624 of 2016, whereby and whereunder the demand notices have been quashed with a direction that all the payment that has been made by the petitioner for the period between 12.01.2015 to 23.12.2015 shall be adjusted towards the future contributions and appropriate demand notice for the future shall be raised by the respondents No. 4, for its reference paragraph-7 of the said order is being referred herein below; “7. In that view of the matter, the legal question appearing in this case is no longer res integra. It is further put to our notice by the petitioner that the aforesaid judgment has been relied upon by the High Court of Chhattisgarh, Bilaspur in WPC No. 1504 of 2016 as well as by the Karnataka High Court in Writ Petition No. 36037 of 2016 (GM-MM-S) as per the judgments dated 24.11.2017 and 15.09.2018 respectively. In that view of the matter, since nothing more is to be decided because of the covered judgments passed, we are inclined to allow the writ application. This writ application is accordingly allowed. The impugned demand notice is hereby quashed with a direction that all the payment that has been made by the petitioner for the period between 12.01.2015 to 23.12.2015 shall be adjusted towards the future contributions and appropriate demand notice for the future shall be raised by the respondent No.4.” 11. Further the order passed by the Co-ordinate Division Bench in 54 W.P.(C) No. 6824 of 2016 with W.P.(C) No. 6825 of 2016 which was decided on 21.08.2023 the writ petitions have been allowed with a direction that any deposit made by the petitioners towards contribution to the District Mining Fund in between 12.01.2015 to 22.03.2016 shall be adjusted towards the future contribution of the respective petitioners and appropriate demand notice for the future shall be raised by respondent No. 5. 12. Considering the aforesaid ratio and the decision having been taken by the Co-ordinate Division Bench while disposing of the writ petitions, we are of the view that since, the matter has already been decided by setting at rest by the Hon‟ble Apex Court, hence, all the writ petitions needs to be disposed of. 13. Accordingly, the demand notices issued in respective writ petitions as impugned are hereby quashed and set aside. 14. However, any deposit made by the petitioners towards contribution in the District Mining Fund in between 12.01.2015 to 22.03.2016 shall be adjusted towards the future contribution of the respective petitioners and appropriate demand notice for the future shall be raised by the concerned respondent. 15. Accordingly, all the writ petitions stands disposed of with the aforesaid direction. Consequently, the pending Interlocutory Applications also stands disposed of. (Sujit Narayan Prasad, J.)
