JUSTICE NARENDRA NATH TIWARI ------ For the petitioner For the State : : ------ Mr. Dhananjay Kr.Dubey, Advocate J.C. to A.G. 3/05.03.2013: In this writ petition, the petitioner has challenged the order of punishment dated 13.6.2012, as contained in Annexure-7, whereby the petitioner has been awarded dismissal from service and also the appellate order dated 19.10.2012, as contained in Annexure-9. The main grounds to challenge the orders are non-consideration of the materials and evidences on record and the orders, being based on no legal evidence, are perverse and violative of principle of natural justice. Before the case is argued in detail, learned J.C. to A.G. appearing on behalf of the respondents submitted that against the order of punishment and order dismissing appeal, the petitioner has preferred revision in the form of memorial before the Director General of Police, Jharkhand and the same is still pending. The writ petition is, thus, pre- mature and is liable to be dismissed. The said fact of pendency of the memorial before the Director General of Police, Jharkhand has been accepted by the petitioner. In view of the said admitted position and pendency of revision before the Director General of Police and without going into the merit of the case, this writ petition is disposed of directing the Director General of Police, Jharkhand, Ranchi – respondent no.2 to consider and dispose of the petitioner's memorial pending since November, 2012 within three months from the date of receipt/production of a copy of this order. -2- After disposal of the memorial, the said respondent shall communicate the order to the petitioner in writing.
