This bail application has been filed on behalf of the applicant–Vijay Paswan with prayer to release on bail in connection with Bhawnathpur P.S. Case No. 143 of 2021, registered under Sections 452/323/307/34 of the Indian Penal Code, pending in the court of the Judicial Magistrate, First Class, Garhwa. Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged by the informant against five named accused persons including the applicant with these allegations that all the accused persons intruded in the house of the informant and assaulted to the informant and minor daughter Radhika Kumari. Learned Counsel for the applicant has submitted that as per F.I.R. allegations the injured are informant and her daughter. As per injury report, nature of injuries was simple and though the injury to the daughter of the informant was on vital part. The applicant has been languishing in jail since

08.10.2021. Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant and contended that though the injuries were simple in nature yet injury to the daughter of the informant was on vital part. The applicant is also having criminal antecedent. In view of the submissions made and materials on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
