A.P.P. ---------- 02/ 23.01.2013 The petitioner is an accused in a case registered under Sections 386/387/506 and 120B of the Indian Penal Code. It reveals from the F.I.R. that co-accused Tahir Ansari has formed a criminal gang and the gang is indulged in collecting ‘Rangdari’ from the Contractors and other people. On the date of incident Tahir Ansari with his three associates was apprehended by the police and this case was registered. It is submitted that two of the accused Ajay Pd. Ram and Lalji Singh, who were arrested along with Tahir Ansari have been granted bail by this Court vide B.A.No.8460 of 2012. The petitioner was not at all present at the place of occurrence with said Tahir Anari and he has been implicated only because he is the resident of same village. Counsel for the State has opposed the prayer. Since the other accused, who were arrested by the police on the spot have been granted bail, I do feel inclined to give same benefit to this petitioner. Accordingly, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of like amount each to the satisfaction of the Civil Judge (Jr. Division)-I at Garhwa in connection with Nagaruntari P.S. Case No. 159 of 2012, corresponding to G.R.No.1487 of 2012. P.K.S. [D.N.Upadhyay,J.]
