As per the averments as made in the application, the impugned judgment was passed on 07.03.2025. The certified copy of the judgment was applied by the learned counsel for the applicant on 01.04.2025 and the same was delivered on 24.04.2025. It has been contended that while preparing the appeal certain documents were required and after obtaining the same, immediately, the appeal was prepared and, in this process, a delay of 2 days occurred, is neither intentional nor willful, but due unavoidable circumstances. Consequently, in view of the averments made in the application, which is duly supported by an affidavit and in view of submissions as made by learned senior counsel for the applicant, the present application is allowed and delay in filing the appeal is condoned.
