The learned Single Judge has decided the matter on the basis of a judgment rendered by this Court in Rakesh Kumar Vs. State of H.P. and others, CWP No.2735 of 2010. 2
It is brought to the notice of this Court that the matter, in principle, is pending before the Apex Court. Therefore, it is made clear that the implementation of the judgment referred to above would depend upon the outcome of the case, now pending before the Apex Court and the needful action, if required, will be taken within another two months from the date of the judgment of the Apex Court.
