Judgment

of the parties. The application stands disposed of. CMP No.5062 of 2019 By way of instant application filed under Section 151 of the Code of Civil Procedure, prayer has been made on behalf of LRs No.4(a) to 4(e) of deceased respondent No.4, Mohan Lal, for the release of the award amount lying deposited in the Registry of this Court along with up-to-date interest.

Learned counsel representing the non- applicant/ appellant states that he does not intend to file any reply to the application and has no objection in case the prayer made in the application is allowed.

Averments contained in the application, which is duly supported by an afÏdavit, clearly suggest that appeal having been filed by the non- applicant/appellant, laying therein challenge to the award passed by learned Tribunal below, stands finally decided by this Court and no appeal, whatsoever has been filed against the judgment dated 3.4.2012 passed by this Court and as such, same has attained finality. Applicants/respondents No.4(a) to 4(h) have already been ordered to be brought on record as legal representatives of deceased respondent No.4 vide order dated

25.6.2019 passed in CMP No.5062 of 2019 and as such, this Court sees no impediment in accepting the prayer made in the application..

Accordingly, the present application is allowed and Registry is directed to release the award amount along with up-to-date interest in favour of applicants/respondents No.4(a) to 4(e), strictly as per their share, by remitting the same in their bank accounts, details whereof are given in para-2 of the application, subject to the verification by the Accounts Branch.
