Aggrieved by the said dismissal, he preferred H.M.C.A.No.33 of 2005 before the Principal District Court, Srivilliputhur, which was also dismissed. Challenging the same, C.M.S.A.No.17 of 2009 was filed before this Court and the same too was dismissed. Challenging the concurrent findings, an appeal is presently pending before the Hon’ble Supreme Court.5.During the pendency of the aforesaid proceedings, Thamarai selvi filed M.C.No.16 of 2019 on the file of the learned Judicial Magistrate No. II, sattur, seeking maintenance of Rs.35,000/- per month for her and daughter. In the said petition, the petitioner stated that the respondent was drawing a monthly salary of Rs.75,000/- and had not made any payment towards maintenance for the past 16 years. Pending disposal of the said revision petition without any stay of the order, the petitioner filed an Execution Petition before the learned Judicial Magistrate No. II, sattur, in Crl.M.P.No.8423 of 2023, stating that the respondent had not paid any amount and that the arrears of maintenance had accumulated to more than Rs.9,66,667/-.
