By consent of both the parties, the writ petition is taken for final disposal at the admission stage itself. 4. The facts as set out in the affidavit filed in support of the writ petition reads as follows:- It is the case of the petitioner that she had completed her SSLC during March 2019 securing 91.8% of marks. Thereafter, she had completed her Higher Secondary Course in May 2021 from the State Board of School Examinations, Tamil Nadu securing 92.82% marks. The petitioner who desired to be a doctor had made effective efforts to write the examination conducted by the National Medical Commission namely National Eligibility Cum Entrance Test (UG) 2025 hereinafter referred to as NEET 2025. The NEET examination was conducted on 04.05.2025 and the petitioner had secured 383 marks out of 720 marks and the marks were published on 14.06.2025.3/10 https://www.mhc.tn.gov.in/judis W.P.(MD)No.29182 of 2025 5. The petitioner would submit that she had made an application for MBBS/BDS Course 2025-2026 before the 2nd respondent under the Government Quota under Application No.25UG830258 on 15.06.2025 and also under the management quota in Application No.25UG915732 on the very same day. Since the petitioner had only secured 383 marks in the NEET Examination she was not considered in the 1st round of the Tamil Nadu UG-MBBS and BDS Counselling. She was allotted the BDS Course in the management quota in CSI College of Dental Science and Research, Madurai on 18.08.2025. Thereafter, she was opted out of the said college and was re-allotted a seat in the BDS Course under the management quota (SF Colleges) in Karpaga Vinayaga Institute of Dental Sciences, Chinnakolambakkam, Kanchipuram District. 6. The petitioner would submit that the 2nd respondent had released the provisional list of candidates allotted for MBBS/BDS management quota for the session 2025-2026 on 24.09.2025, wherein the petitioner's name did not feature. 4/10 https://www.mhc.tn.gov.in/judis W.P.(MD)No.29182 of 2025 7. It is the contention that she had failed to enclose her Christian Minority Certificate under Annexure-1(b) along with the application submitted by her under the management quota. Therefore, she had sent a mail to the 2nd respondent on 17.09.2025 enclosing the copies of the Christian Minority Certificate issued to her and requesting the 2nd respondent to consider her request. 8. The petitioner would submit that she had made a detailed representation on 30.09.2025 enclosing the certificate issued to her which was however not taken into consideration by the 2nd respondent. The 2nd respondent has now announced the schedule for the 3rd round of counselling for admission to MBBS/BDS Course fixing the date of registration from 06.10.2025 10.00 A.M. to 09.10.2025 till 05.00 P.M and choice filling and locking to be scheduled from 11.10.2025 10.00 A.M. to 14.10.2025 05.00 P.M.9. The petitioner would submit that she had registered her name with the 2nd respondent for the 3rd round of counselling for management 5/10 https://www.mhc.tn.gov.in/judis W.P.(MD)No.29182 of 2025 quota on 07.10.2025. While so, a notification dated 09.10.2025 was issued by the 2nd respondent revising the schedule for the 3rd round of counselling, wherein it was stated that the candidate could register till 12.10.2025 5.00 P.M. and candidate can fill their choices and lock their choices from 13.10.2025 5.00 P.M. to 16.10.2025 05.00 P.M. and the process of seat allotment would be doe on 17.10.2025 and results would be published on 18.10.2025. 10. The petitioner would submit that though the candidates who have secured mark in the NEET Examination and who had submitted their Religious/Linguistic Minority Certificate under Annexure-1(b) had been allotted MBBS seat under the category of minority in management quota in Self Financing/Private Colleges and seats have also been allotted to them on 24.09.2025. However, the petitioner's candidature has not been considered for the simple reason for that she has not enclosed Christian Minority Certificate at the time of application. Heard the learned counsel on either side and perused the materials available on records.12. A perusal of the application that has been filed by the petitioner on 15.06.2025 under the management quota in Application No. 25UG915732 would clearly indicate that the petitioner had not applied either under the Linguistic Minority Category or under the Religious Minority Category. The petitioner has attended the 1st and 2nd counselling without claiming the Religious Minority Category. 13. It is only on 08.09.2025 the petitioner had obtained the Religious Minority Certificate and on 30.09.2025 she had submitted the same to the 2nd respondent stating that the Religious Minority Certificate has not been enclosed by mistake. Such statement is incorrect in the light of the earlier application submitted by the petitioner on 15.06.2025, wherein she has clearly and categorically stated that she was not making her application under the Religious Minority Category, a statement that had been made consciously and after fully comprehending the contents of the application. 7/10 https://www.mhc.tn.gov.in/judis W.P.(MD)No.29182 of 2025 14. That apart, it is informed by the learned Special Standing Counsel appearing for the 2nd respondent that the seats under Christian Minority Category has been completely filled up. Therefore, there has been no failure on the part of the respondents in the discharge of their duties and on the contrary, it is the petitioner who has not cared to apply and submit the certificates at the first instance. Therefore, the prayer of the petitioner seeking a mandamus cannot be granted. 15. Accordingly, the writ petition stands dismissed. No costs.
