ORDER :

The Court Made the following order :-The petitioners/accused apprehend arrest at the hands of the respondent police for the alleged offences under Section 3(1) TNPPDLAct, in Crime No.338 of 2011 on the file of the respondent police and hence, seek anticipatory bail.

Heard Mr.N.Anand Kumar, learned counsel for the petitioners and Mr.K.S.Duraipandian, learned Government Advocate (Crl. Side)appearing for the respondent State.

The learned counsel appearing for the petitioner would submit in his argument that the case of the prosecution is that the petitioners went to the Alapampatcheri Bus Stand and holding the stone and throw the same on the bus and broken the glass and thus caused damage worth about Rs.13,500/-. He would further submit that the petitioners are innocent persons and they have been falsely implicated in this case and they are ready to abide any condition likely to be imposed on them and hence, the petitioners may be released on anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/

The learned Additional Public Prosecutor would submit in his argument that the investigation is offing and if for any reasons, this Court is inclined to grant anticipatory bail to the petitioner, suitable conditions may be imposed against them.

Considering the submissions made by both sides, this Court is inclined to grant anticipatory bail to the petitioners with certain condition. Accordingly, the petitioners are directed to be released on bail, in the event of his arrest or on his appearance before the Judicial Magistrate concerned on condition that the petitioners shall deposit a sum of Rs.6,750/- (Rupees six thousand and seven hundred and fifty only) before the learned Additional District Munsif Court cumJudicial Magistrate, Manamadurai, to the credit of crime No.338 of2011 on the file of the respondent police and on such deposit, the petitioners shall execute a separate bond for a sum of Rs.10,000/-(Rupees Ten thousand Only) with two sureties each for a like sum to the satisfaction of the learned Additional District Munsif Court cumJudicial Magistrate, Manamadurai, and on further condition that the petitioners shall appear before the respondent police as and when required for the purpose of interrogation.
